The motion is to suppress the entire traffic stop by police that night, on claims Obama was not committing any motor vehicle violations that night at 7.

His 4th Amendment rights were not violated. Driving a vehicle gives the LEOs implied consent to do a Breathalyser Test, a sobriety Test, or a BAT if you refuse the first two when he was suspected of DUI.

The judge should deny the motion.

Wouldn't hurt if the judge referred the Lawyer's actions to the state BAR Discipline Board either.

You lose a lot of rights once you get behind the wheel of a vehicle.
