I don’t think anybody is suggesting that Paterno is legally in the wrong. But there are still a lot of questions, and the bottom line is, if Paterno wanted the molestations to stop, it would have been stopped. Even if he had to go to Sandusky directly and confront him about it.

Paterno’s “Departure” is being managed by the University to make it look like if HE goes away, so does the issue, saving everyone’s butts and retirements.

Remember, these people live in a bubble, Happy Valley, and are the KINGS of their domain. No one will dare to question them, after all, they are gods of the campus, and they have “Handled it”.

Possibly. He was an employee of a state institution. He knew that state law required the reporting to child services or to the police. He knew that that wasn't done. He knew that school officials had thus broken the law. I would think that as a state employee he would be required to report to the state obvious violations of state law by PSU officials.

Pains me to say this, but I think the DA had enough to charge Paterno if she had chosen to press the point. The questioning of McCreary & Paterno left the issue of "what exactly Joe was told" wide open. I think that was by design because the prosecution needs Joe's testimony.

There are ethical standards and expectations for people in power and then there are also laws that come into play in situations.

Ethical standards were severely breached but Paterno was not indicted for breaking laws. He won’t go to jail but he and all the University employees who knew and did not stop him, should be fired for breaching ethical standards.
