Your post is predicated on the assumption that a written set of rules, laws, constitutions, or contracts
trumps the assumption of modern liberals that their intellect and special knowledge of the present to make ad hoc decisions.
They don’t have the same assumption that you do.
This is partly the post-modernist philosophy, and partly the evolutionary mindset (things/people/intellect getting better and better with time).
