An explosive sex abuse scandal and possible cover-up rocked Happy Valley after former Penn State defensive coordinator Jerry Sandusky, once considered Joe Paterno's heir apparent, was charged with sexually assaulting eight boys over a 15-year period. Among the allegations was that a graduate assistant saw Sandusky assault a boy in the shower at the Nittany Lions' practice center in 2002.
Sandusky retired in 1999 but continued to use the school's facilities for his work with The Second Mile, a foundation he established to help at-risk kids. The state grand jury investigation also resulted in perjury charges against Tim Curley, Penn State's athletic director, and Gary Schultz, vice president for finance and business. The two administrators were accused of failing to alert police as required by state law of their investigation of the allegations.
"This is a case about a sexual predator who used his position within the university and community to repeatedly prey on young boys," state Attorney General Linda Kelly said Saturday in a statement.
Paterno, who last week became the winningest coach in Division I football, wasn't charged, and the grand jury report didn't appear to implicate him in wrongdoing.

To Hell with that. I am passing judgement. The police should have been called. How many children did Sandusky rape after this particular incident? How many children could have been spared his predations if someone had possessed the stones to do the right thing??
Something else I’m wondering: Considering the number of parents who kept quiet, I’m wondering if any money changed hands to buy their silence and if so, where the money came from.
Nobody reported the 2002 rape to campus PD. It was all administrative. The 1998 incident was reported to campus police, they investigated and Paterno asked him to retire(at 55)because of it. So clearly everyone in the PSU Administration from JoePa on up knew this guy was assaulting kids over a multi year period. And all they did was CYA.

You’re connecting dots that aren’t there. Most sources say that Paterno and Sandusky did not have a good relationship. There is nothing to suggest that Paterno asking Sandusky to retire was because he knew he was a pederast and wanted to cover up for him. Now, I believe that the 1998 investigation was a direct reason because Paterno and others knew something was up. Unless you wanted them to set up a sting operation with hidden cameras, they did what they could. They knew something was up but had no evidence (and apparently the police didn’t either) so they “encouraged” his retirement.

Based on the wording of the mandated reporting requirements, I’m trying to understand how an official of a public university who receives a second-hand report of child molestation (and/or maybe even who witnesses it directly) are covered by those requirements.
Specifically, I am referring to the wording, “that a child coming before them in their professional or official capacity is a victim of child abuse”, and the proper interpretation of “a child coming before them”.
Does that require a direct relationship between the official and the child, or does “coming before them in their professional or official capacity” mean that the issue or report comes to their attention, but not that the individual victim be physically present before that official when the official is conducting their duties (such as would be the case with a health care professional who is directly responsible for examining the child, or an elementary school teacher who is teaching the child).
I am also unsure of the applicability of the first provision of the law to this situation, namely “licensees who, in the course of the employment, occupation or practice of their profession, come into contact with children”. In what way are those officials “licensees” (and in fact, what is the definition of “children” - is a college freshman considered to be a child under this part of the law?).
Moral imperatives are a different issue - I am just referring to whether and how the persons involved in this situation meet the legal requirements for reporting.

I would imagine there will be a lot of retirements "encouraged", by the Big Ten and Penn State.
I’d like to know this as well. I had read elsewhere that it applied to the individuals in charge of an institution, so whether this applies to Curley or not is unknown.
Okay, what about the fact that even after he retired Sandusky kept his office, his keys, his unlimited access to the program and facilities and players, was on campus all the time...
I would assume that Joe Paterno holds some amount of sway at Penn State and if he said “Yo, I don’t like that guy,” something would be done about it.
That was negotiated as part of his retirement and the ban on bringing children on campus was apparently unenforceable. I don’t think it was acceptable overall given the circumstances, but then again there were no criminal charges in 1998 (which we know now was a huge error). I personally have no idea how much power Paterno had over Sandusky’s involvement after 1999.
There was a clear pattern known to the University after 2002. A lot of University officials are at fault here, but I have no reason to believe Paterno is one of them. By the way, I will personally volunteer to execute Sandusky.
