Cain camp considering legal action against Politico

A Herman Cain aide said Thursday that the Cain campaign is considering its legal options over the original Politico story, which revealed that the former head of the National Restaurant Association was accused of sexually harassing at least two women during his tenure in the 1990s.

“This is likely not over with Politico from a legal perspective,” a campaign official told the Post, stopping short of explaining what exactly he meant by taking legal action against the publication.

The Cain campaign has had an attorney advising it since Saturday on crisis management, which hasn’t gone particularly well for Cain since the story broke Sunday night.

On Thursday night, Politico reported more details of the allegations against Cain, saying that the former NRA head made a “sexual overture to [one of the women] at one of the group’s events.”

Politico cited “multiple sources independently familiar with the matter” and said the woman in question was “livid” and reported the incident that night to an NRA board member. She left the trade group soon afterwards, the publication reported,

The whole issue isn't about Cain, the media will smear any conservative candidate gaining in the polls. Innuendos, rumors, anything it takes to knock them out of the running.

Jounolist type group attack, also diverts the news cycle away from Crime Inc.

Assuming Cain brought a slander/defamation case (and I can't think of another cause of action that would be even remotely feasible), his case would probably not survive a motion to dismiss, so it would never even get to discovery. As a public figure, Cain would need to show that Politico acted with "actual malice," meaning that they knew that what they were publishing was false, or that they acted with reckless disregard of the truth. Considering that (a) Cain himself has confirmed a substantial portion of what they wrote (e.g., the existence of the settlement and the general subject matter of the complaint), and (b) Politico has been careful to couch much of what they've written in "sources report...." terms, it would be virtually impossible for Cain to meet this standard.

In your mind, maybe, I listened him on hannity for an hour, if the woman has info walk out and present it, until then it is all, what ifs and maybes. Nothing more.

The dumb womans attorney, admits he has no records and it was handled by phone and fax. He does not even know what was agreed to and for what. And it was reported on Rush she, the client, had told her attorney to sit down and shut up.

Mark levin called him to see if he would talk about it. He has not showed up yet. Maybe you should call and tell him your inside knowledge.

Cain has confirmed most of the initial allegations. There is nothing here to sue for. If he files suit, his campaign is dead in the water, if it isn’t already. Jeez, this guy is lame.
Don't worry. If this campaign sticks to pattern, it will be "sue" today and walk-it-back tomorrow.

I dunno, probably smart to rattle this saber, but I think he’d be better off leaving it in the scabbard. This will all blow over in another week or so, and a lawsuit would keep it in the news.

Whenever Team Romney had rumors they wanted to start about other candidates,
Jonathan Martin has been their go-to guy to get those rumors in writing in front of a national audience.

You see, Jonny wrote a piss poor story the other day about how the Iowa Family Policy Center will be paying a large speaker fee if Sarah Palin comes to Iowa to keynote the IFPC’s fall funderaiser.
The only problem is that Jonny has no sources confirming that any exorbitant fee is being charged or paid.
Jonny also got some inside info from David Kochel, who was a top aide to former (and future) presidential candidate, Mitt Romney.
Hey Dave, didn’t I just read a story about how Mitt Romney tried to buy off the Iowa Christian Alliance?

One thing I see is that Cain would be making a terrible mistake if all this hubbub were true.

For some reason, he has not backed out. That is what I would expect a guilty person to do.

I am not sure Cain is the right guy. What I am sure of is that so far, I have not been shown proof that the charges are true.

If anyone is out there that wants to prove Cain is somehow guilty of what he is allegedly accused of, they need to come forth and duke it out with Cain in the public arena.

If they are too cowardly to do that, Cain wins. And that does not mean he should be President. It means that what he is accused of has no standing.
