It's just plain old rape. Unfortunately, they are also trying to use the American-liberal mentality of "Hate Crime" (i.e. Thought Crime) to make this particular motivation extra-special.
Prosecute for the action, and the discernible intent (e.g. malice aforethought), but not some pop-psyche notion of hate.
The crime itself is bad enough without this extra carp muddying the waters.

its just rape...forceable sexual assualt because they can get away with it...
