The state has been unable to enforce a new law designed to increase the deportations of illegal immigrants from the Texas prison system amid concerns that federal immigration officials are unprepared to handle the anticipated influx of convicted criminals, state officials said.
Under the new law, which was scheduled to take effect Sept. 1, state prisoners who are granted parole and turned over to Immigration and Customs Enforcement officials must either be deported or leave the country voluntarily - or risk being returned to state custody to serve out the remainder of their sentences.
The law was crafted to address a vexing problem identified by the Texas Board of Pardons and Paroles, which reported granting parole to some illegal immigrants and turning them over to ICE - only to later learn that they were not removed from the country, said state Rep. Jerry Madden, R-Plano.
...ICE union officials said part of the problem lies in a shortage of immigration judges assigned to hear cases in Huntsville. The immigration court system is run by a separate agency, the Executive Office for Immigration Review, which declined comment on Thursday.
Rissie Owens, chair of the Texas Board of Pardons and Paroles, said that unless ICE has finished its removal proceedings, board members can't be sure that "those they vote to release are actually deported and not released into our communities where they may be a threat to pubic safety."
ICE data shows that roughly one in five of the 5,000 illegal immigrants discharged annually lacks a final removal order clearing the way for deportation.

Fully 69% of Americans in the latest IBD/TIPP poll say they dont favor states giving in-state college tuition to illegal residents while charging higher fees for legal, out-of-state residents. Just 22% support such a policy.
73% of Republicans are opposed vs. 20% in favor.
Independents have even stronger views: 74%-15%. Even Democrats are strongly opposed 58%-32%.
In fact, a majority of every major subgroup opposes giving illegals in-state tuition rates men and women, rich and poor, urban and rural. Hispanics, who have more conflicted views over illegal immigration than is commonly known, are opposed, 54%-28%. Blacks, who often see illegal immigrants as rivals for jobs, are the most opposed, 80%-12%.
And Perry told them the had no heart because they dared to disagree with him. That was really, really stupid.

I wonder if states could impose voluntarily leaving the US as a *condition* for parole? As with the Arizona program, where voluntary deportees get a free flight to Mexico City, it takes both the federal government and involuntary deportation off the table.

I truly believe RINO Rick Perry's campaign is history. That doesn't mean I can't or shouldn't enjoy watching him flounder like a fish out of water in his vain attempt to regain the support he pushed away when he called them heartless.

As long as he is spending other peoples' money (something he is good at) he will stay in. And as long as he's going after the other RINO in the race, Mitt Romney, I think he should. But when he goes after Herman Cain, the only man standing between Romney and the Republican nomination then it is time for Ricardo to pack it in. I really don't think he is that smart, though. He does come across as being one of the least intelligent candidates in the field.
