I did not remember that it was a Supreme Court ruling...but should have!
I think instate tuition would be an extension of this. Had a suit been filed on that in TX? I think I read that in one state the illegals were suing for instate tuition.
I haven’t finished reading up on that law (the link froze my crappy phone), but I do have one question. Was it a matter of “you don’t get federal funds if you don’t educate them” or literally, the feds trying to FORCE states to allow them in...
If so, that is blatanly 10th amendment territory and why haven’t any of our lilly livered good for nothing idiot governors ever challenged it???
My point is, what if a state decides to turn over all education to private schools and give tax money for it back to parents to pay for their children’s education??? Would the feds establish a “federal school” in that state just for illegals??? Please help me understand this... and thank you Doc for the info...

Here’s the opinion.
APPEAL FROM THE UNITED STATES COURT OF APPEALS FOR THE FIFTH CIRCUIT
No. 80-1538 Argued: December 1, 1981 -— Decided: June 15, 1982 [*]
JUSTICE BRENNAN delivered the opinion of the Court.
The question presented by these cases is whether, consistent with the Equal Protection Clause of the Fourteenth Amendment, Texas may deny to undocumented school-age children the free public education that it provides to children who are citizens of the United States or legally admitted aliens.
