I haven’t finished reading up on that law (the link froze my crappy phone), but I do have one question. Was it a matter of “you don’t get federal funds if you don’t educate them” or literally, the feds trying to FORCE states to allow them in...

If so, that is blatanly 10th amendment territory and why haven’t any of our lilly livered good for nothing idiot governors ever challenged it???

My point is, what if a state decides to turn over all education to private schools and give tax money for it back to parents to pay for their children’s education??? Would the feds establish a “federal school” in that state just for illegals??? Please help me understand this... and thank you Doc for the info...

I don't recall mention of funding. I skimmed it about 2:30 a.m.

As I said earlier, the ESL training classes are held all over the country so I am assuming this is not just a tX thing. I also THINK that the instate tuition passed in TX was because a suit was about to be filed on that and there is no way this court ruling wouldn't have extended to instate tuition for illegals for the same reasons...that met all the other criteria.

I'm not a lawyer.
