NO ONE EVER passes a field sobriety test ... don't ever take one

don't refuse .... ask if there are any legal consequences to taking the test

Remain polite and clearly state for the camera that you are not refusing but that you would like to have advice of counsel before taking the test

keep breathing deeply and let them either make the claim that you are refusing the test .. which you repeated claim that you are not .... and when they arrest you explain to counsel that you never refused but asked if there was a legal consequence to the test and when told there was asked for advice of counsel before taking any test.

If you remain cool and courteous you should walk

Good thing I wasn’t asked the only time I was stopped (and I was stopped - in a lit church parking lot after a long drive and I couldn’t keep my eyes open). The whole police force in a small Texas town surrounded my P/U and skipped the stand-on-one-foot test and went right to the breathalizer test: Blew 0.00. They then said I could not stay there but had to park at the local convenience store lot. I said o.k. but was then awake enough to drive the remaining 30 miles.
