Sarah Palins family attorney John Tiemessen has written a letter to Maya Mavjee, the publisher of the Crown Publishing Group, a division of Random House, that Palin may sue her, the company, and the books author Joe McGinniss for knowingly publishing false statements in his book released last week, The Rogue, ABC News has learned.
The book was widely panned by critics for using unnamed sources to criticize Palin and her family. Tiemessen cites an email they have access to in which McGinniss writes that attorneys from Crown Publishing told him nothing I can cite other than my own reporting rises above the level of tawdry gossip. The proof is always just around the corner, but that is a corner nobody has been able to turn and that McGinniss ran out of time to sufficiently source the book.
A source close to the Palins tells ABC News that the Palins are fighting back and demanding answers from Random House.
Random House is at the top of the food chain and published a book based upon acknowledged unsubstantiated gossip, the source said. The revealing email is key as evidence of this defamatory approach to politics through proxies.
Tiemessen writes in the letter that the email clearly describes the fact that Mr. McGinniss researched and investigated many false and scurrilous allegations, and concluded that there was absolutely no evidence anywhere backing these allegations.
Palins attorney writes that it is malicious for Crown to publish the book when it has proof McGinniss and Crown were fully aware the statements in the book were false, intended to be false, and were intended to harm.

Tea Partiers want a candidate they’re sure will fight for them. Seeing the Momma Grizzly fight for her family against the corrupt evil establishment will make them ecstatic. My only question is how long has Breitbart been sitting on these e-mails? And had he clued Sarah in on their existence? Had they just been waiting to see whether Sloppy Joe et al would be dumb enough to finish the tort? And if so planning to jiu jitsu liberal hate and stupidity into the most unconventional election launch in history. One that converts three years of the left’s negative campaigning into legally admitted or proven “making things up.”
What if the basketball player is willing to perjure himself? This could also be a last ditch trap. They would be able to call defense witnesses and make life miserable for a lot of people. How about them putting Bristol on the stand and ripping her life apart like they do a rape victim?
That letter is action.
ABC is clueless.
Possibly, and that is one of my concerns. But the high risk of ultimately losing, and the scope of what will be lost, should put enormous pressure on defendants to settle. Law as vengance is a fool's game. She needs an elegant way to win this without getting bogged down by it. Else, even if she wins, she may still lose.

My bet is that they do pursue the case, and receive a sizeable settlement w/o going to court.

I think they can accomplish that w/o going into a court room; I’m sure that they will retract, and pay quickly.

He blew it by not understanding his market. Liberals are mostly cheapskates, and they will usually buy only books that reassure their twisted dream world by making their heroes look good, like Bill and Hill.
They don’t want a book about Palin; they just want to hate Palin.
He included family members; she has already won.
Also, there are three or four states that require criminal penalties for leveling false charges against candidates and public figures.

When you send an email, unencrypted, it can be found by search engines on the servers that they pass through, using key words. Police do this regularly. Anyone that has one of these search engines can do it.

McGiness isn’t intelligent enough to recognize what is incriminating.

RH must be out thousands of $s. Consider the ‘advance’, probably picked up some of the tab for the sleazeball, editing, publishing and so forth.
If Palin sues, it should put a real dent into RH’s financials. Best case scenario: hurt RH so severely that it will be impossible for them to recover.

I look at this from the standpoint of trying to put myself in Palin’s shoes... For 3+ years, she and her family/children have been subject to a near constant barrage of attacks on her professional life, her personal life, and their personal lives. New “ground” in “journalism” has certainly been broken...accusing someone of faking a pregnancy! (on top of all the other ludicrous accusations). The media has invested countless millions of $$ attempting to destroy this woman. Yet, as we all have marveled, she keeps plugging on, smiling, optimistic, serving as a source of inspiration for many. But, she’s only human and no one could withstand that sustained, high octane, viciously personal barrage without it having some effect. Perhaps, this “book”, done by someone who forthrightly stalked her and her family in the most intimate forms possible, is the breaking point and she wants to put an end to the “open season” on the Palin family. I would imagine she would go through with this, Prez run or not. She does not seem like someone who you would want to make tremendously angry. I can envision a “Carrie”-like scenario (in legal terms, not literally, of course) where she will make such a definitive statement as to take the personal Palin family “issues” off the table and serve notice to wannabees like Letterman and the other uber-Left snark-meisters that there are consequences to their actions.

Todd or Sarah probably gave the emails to Breitbart after they intercepted them in Wasilla from Griffin's blogger network, in which McGinniss was reaching out for help.
That’s why she has a lawyer to handle this situation. Suing Random House and this idiot will put others on notice to be very careful with what they say and write.
How did that work out for Roger Clemens? Roger hasn't been convicted, but he is spending a bundle on his lawyer.
