The shale on my property is a rock on the other hand the shale 100 miles north of me is gold.

Is it animal, mineral or vegetable?

Doesn’t matter, the Government will find a way to control it, if they want it.

Of course it may all depend on why the meaning of "is,"is.

It would probably fit into the description of “mineral”

Where would it fit in the "Energy Resource" category? Probably not Green, so it will be identified with the category that will give the government maximum control. Words actually mean things but only when they want them to.

Whatever it is, it will end up being a negotiated settlement. I recall a case a few years back. Some guy had filed a mining claim under the 1857 mining acts for a piece of land that was totally loaded with quartz.

Real quartz! Quartz crystals, quartz layers, tons of quartz!

Now quartz actually IS a mineral by all definitions and has landscaping and industrial uses, so he wasn’t just making it up to get the land.

I think USGS or BLM challenged him basically arguing that the statutes didn’t mean quartz, he took it to court, and IIRC, he won.

So, who can say? The end result might depend on which palms get greased...

Do NOT color me surprised if that idea is actually submitted to the UN or some other international court of clowns.
