The awful launch week for the over-hyped, expected bestseller The Rogue: Searching for the Real Sarah Palin, by controversial author Joe McGinniss, just got worse. Much worse.
After a week of universally scathing pans from the reflexively anti-Palin establishment media, McGinniss now faces the fight of his literary life: the accusation that he seems to have knowingly submitted a book to his publisher, Crown/Random House, that was filled with unproved tawdry gossip and rumors that lacked factual evidence.

No documentation, no proof whatsoever. Yet will that stop them from publishing? I hope and pray that they do, and that the Palins end up owning everything, everything McGinniss has ever made, and everything he ever will make. Ditto Random House - put them out of (their unethical) business.

Not necessarily. Defamation can occur by way of innuendo. Uncritically repeating a rumor makes you a "publisher" of that defamatory innuendo and puts you on the hook for a potential claim, depending on what the plaintiff wants to do with you and then on how well your facts match the legal requirements. Judges and juries will generally not be fooled by the thin disguise of "just repeating a rumor," especially when you've got the smoking gun required for a successful NYT Malice case, as appears to be the case here.
Strategically, BTW, Palin can have it both ways if she wants. Run the race without filing suit, then after she either wins or loses, the statute of limitations (most likely 2 years, depending on the state in which the case is brought) will not have run out by November 2012, and she will be free to bring suit without doing damage to her 2012 political efforts.
This could turn McGuinness/Random House into Sarah Palin's biggest donors. Sweet justice.

Success probability on a defamation/libel claim aside, this e-mail, assuming it's accurate, directly undercuts the impression the book is trying to leave, and it also makes McGinniss out to be quite the snake.

This is a clear case of what I call the “Bogey Man” theory.
Tell horror stories about monsters eating small children in their sleep, wait until they are going to bed and then tell them that it was all made up and is not true.
Too late......they have already formed the specter of being eaten alive in their sleep and no matter what you tell them after that, they will continue thinking about and worrying themselves sick about it all night long.
It is a principle of normal human behavior and propagandists use it exclusively to smear their targets.
Rule: Once said, most believe it whether false or not.
My guess is that the email leaked from Griffin's circle of anklebiter friends (through friends of friends of Palin contacts or even Bristol or Willow themselves, who are plugged into the Wasilla social network), all of whom have big mouths and are utterly unable to keep a secret amongst themselves concerning their plots and smear attempts.
That's a keeper!

Could Palin obtain an injunction halting the publication and marketing of the book, pending resolution of a defamation action? I agree that a defamation action might merely help promote the book. An injunction, however, would stop it in its tracks, as well as implying that it is, in fact, defamatory.
Breitbart has been a good friend to Gov Palin as far as journalists go, and he seems to still be doing the investigative reporting few others in the media are doing.
I hope this all pans out, and that Gov Palin ends up owning McGinniss and Random House. If she doesn't run for president, perhaps owning a large conservative publishing company would please her.
I would like to see Random House withdraw the book and yank the dirtbag off the book tour. Then they should pay Sarah a considerable amount for her mental anguish.
