Judge halts NC Planned Parenthood cut

RALEIGH, N.C. -- North Carolina cannot withhold funding from Planned Parenthood until a lawsuit over that provision of the state budget has been resolved, a federal judge ruled late Friday.

In a 35-page ruling, Judge James Beaty Jr. sided with Planned Parenthood of Central North Carolina, one of the state's two Planned Parenthood affiliates, in its effort to halt the portion of the state budget that would withhold funding for non-abortion services, a provision referred to throughout the judge's ruling as Section 10.19.

A little over-reach there by a federal judge. That's why someday they will all be disposed of one way or the other ~ presumably peacefully ~ but not in that particular job.

The federal judiciary has outlived the utility of its business model. It's time to return to democratic forms of government.

Judge Beaty is the judge who is presiding over the suits stemming from the Duke lacrosse case.

Those suits are intended to bring about reforms and to compel various persons involved in the attempted railroading of three innocent persons, to divulge just what they knew, and when; and what their actions were.

Beaty has permitted endless stalling—for example, allowing Nifong to claim bankruptcy based on a supposed potential $180 million in liabilities from the suits—while at the same time claiming that he was immune to judgments as a state official.

That held up matters for nearly a year. In the interim, two witnesses died, the city claims it may not be able to find relevant electronic evidence (emails), it may not be able to find relevant computers, and everyone’s memory is “fading”.

Beaty also used his judicial authority to delay any discovery process for over three years (prohibiting even the “mandatory” discovery conference held at the start of a suit).

IOW, in the opinion of many observers, Beaty is dedicated to protecting the establishment in NC from
having to testify to embarrassing and even criminal
actions.

(Beaty also ruled that voluntary prayer before city government meetings in Raleigh was unconstitutional).

These flippin’ “judges” are out of control. Where does this gaseous old windbag get his authority? It sure as hell isn’t in my Constitution. This so called “judge” can pay for these abortions. We taxpayers don’t want to!

As well, Beaty ruled that certain portions of civil rights laws apply only to African-Americans (thus ruling against the Duke lacrosse plaintiffs’ ability to sue under those statutes).

I never heard that there were two standards for civil rights in this country.

As well, in another case his opinion demonstrated that he had never read Lincoln’s Cooper Union address, because he repeated the canard that the Founders considered slaves to be only 3/5 of a person (when in fact, the writers of the Constitution achieved a great victory for abolition, when they had slaves declared to be “persons”, and not “property”).

He comes from a very leftist, militant civil rights background. Growing up black in North Carolina may entitle him to some feelings of bitterness; but as a federal judge he should be expected to know the law and apply it equally, without favor or bias.

Remove him from the bench by force. Jail him and while in there teach this anti-American how you cant force the public to pay for an entity like PP with tax dollars.

Beaty is a Clinton appointee.

Clinton tried to put him on the 4th Circuit but Jesse Helms blocked it in '99.

Clinton then nominated James A. Wynn, Jr. but was blocked by Helms. Bush tried to appoint someone, Terrence Boyle, and gave up after a 5 year battle (Boyle had been a Helms staffer in '73). W's alternative nominee, Robert J. Conrad, Jr., never got a hearing thanks to rat Leahy.

Obama nominated Clinton's prior nominee, Wynn, in '09 and he was approved by unanimous consent a year ago.

Extraordinary: the baby killers at Planned Parenthood have a prior claim on taxpayer money. The people's representatives cannot choose to withhold monies from this private organization. Because the abortion industry gives money to the Democratic Party which hand selected this vile, corrupt judge. How long will we put up with this arrogant judicial tyranny?

I agree. However, North Carolina has a Democrat governor who marches to the tune of the big spending Marxist statists who control the national party. Another state will have to stand tall against the imperial central government.
