New DHS rules cancel deportations

he Homeland Security Department said Thursday it will halt deportation proceedings on a case-by-case basis against illegal immigrants who meet certain criteria such as attending school, having family in the military or are primarily responsible for other family members’ care.

The move, announced in letters to Congress, comes after Hispanic activists and Democrats had urged President Obama to exempt broad swaths of illegal immigrants from deportation while Congress wrestles with the issue.

Homeland Security Secretary Janet Napolitano said her department and the Justice Department will review all ongoing cases and see who meets the new criteria on a case-by-case basis.

“This case-by-case approach will enhance public safety,” she said in the letter. “Immigration judges will be able to more swiftly adjudicate high priority cases, such as those involving convicted felons.”

The new rules apply to those who have been apprehended and are in deportation proceedings, but have not been officially ordered out of the country by a judge. Miss Napolitano said a working group will try to come up with “guidance on how to provide for appropriate discretionary consideration” for “compelling cases” in those instances where someone has already been ordered deported.

It was unclear how many people might be affected by the new rules, though in fiscal year 2010 the government deported nearly 200,000 illegal immigrants who it said did not have criminal records.

It's in red on Drudge. In fact, Drudge is eviscerating Obama today.

Michelle Malkin, whom I love, was on Fox and Friends this am harping on Perry for the Gardisil thing, which was never even implemented, while Napolitano implements the Dream Act on her own.

I just hate the way we eat our own. Focus.

I want to hear these candidates explain how they are going to stop the shadow government bureaucracy, and how soon.

Since the aliens and their supporters are committing FELONIES, how does the DHS get by with refusing to prosecute.

I thought this was interesting. How can the DOJ fight state law enforcement of immigration Laws.

State and local law enforcement officials have the general power to investigate and arrest violators of federal immigration statutes without prior INS knowledge or approval, as long as they are authorized to do so by state law. There is no extant federal limitation on this authority. The 1996 immigration control legislation passed by Congress was intended to encourage states and local agencies to participate in the process of enforcing federal immigration laws. Immigration officers and local law enforcement officers may detain an individual for a brief warrantless interrogation where circumstances create a reasonable suspicion that the individual is illegally present in the U.S. Specific facts constituting a reasonable suspicion include evasive, nervous, or erratic behavior; dress or speech indicating foreign citizenship; and presence in an area known to contain a concentration of illegal aliens. Hispanic appearance alone is not sufficient. Immigration officers and police must have a valid warrant or valid employer’s consent to enter workplaces or residences. Any vehicle used to transport or harbor illegal aliens, or used as a substantial part of an activity that encourages illegal aliens to come to or reside in the U.S. may be seized by an immigration officer and is subject to forfeiture. The forfeiture power covers any conveyances used within the U.S.

Tax Crimes

Employers who aid or abet the preparation of false tax returns by failing to pay income or Social Security taxes for illegal alien employees, or who knowingly make payments using false names or Social Security numbers, are subject to IRS criminal and civil sanctions.

We need to forward this very article to our Senators and Congressmen and tell them we expect that the executive branch of the government will not be the ones making these decisions to pick and choose which laws they like.

If they would just deport all the illegals that come before the court it would not be necessary to clog up the courts, either.

And if they are NOT going to be deporting them, then I am going with the other poster who said they should be able to reduce DHS staff very quickly.

I can’t remember the estimates of how many illegal aliens there are in this country,,but to assert a case-by-case approach is crazy! It’s off-the-charts batChit! There are millions of illegals here,,how in the world is DHS going to get through all of those cases? While the illegals are waiting (years) to get their case heard, they can get a job, grab a family member to care for and meet all the criteria,,are you kidding me? What can we do about this horrible wretched thing that is running DHS?

Aren't these aliens being here a crime? They all have criminal records by default in my book.

Not deporting them violates the Rule of Law. We should never agree or be resigned to it. This should not be allowed to stand. It is an amnesty by decree.
