Yes, it is taxpayer money (or at any rate, a taxpayer funded insurance claim) - and the guilty should absolutely be punished, fined and sued.

However, in a society which purports to have government of, by and for the people, 'we the people' are ultimately responsible for the misdeeds of those we have (however indirectly) authorized to enforce our laws.
