Attorney Representing Vanessa Guerena Files $20 Million Dollar Claim in Tucson

The attorney representing Vanessa Guerena filed a twenty-million dollar lawsuit today naming all of the agencies whose members participated in the SWAT raid, Pima County and the several agencies employing them and Sheriff Clarence Dupnik. Chris Scileppi, the attorney called the raid needless and in a report shown on KOLD TV channel 13 Tucson, a tape ran showing Mrs. Guerena at the door of the home, approached by SWAT members and dragged from the doorway across the gravel front yard after tripping on a dropped ballistic shield. Later in the tape her son was shown walking out of the doorway.

•Scilleppi also called the investigation one of “bad faith” and fraught with “gross negligence”. Again refer to the PDF for specific details.

•Scilleppi also stated that the SWAT team had been advised that Guerena was to be considered “armed and dangerous".

Jose Guerena was the subject of a SWAT raid on his home May 5, 2011 during which he was shot and killed when he alledgedly pointed a AR-15 rifle at the SWAT team upon their entry. His wife, Vanessa Guerena and his four yoer old son were at home at the time.

Guerena was struck by shots fired by the deputies twent-two times out of sevety-one rounds fired and was not approached, examined or treated for his wounds for one hour fourteen minutes.

An investigation by the Pima COUNTY District Attorney's office has cleared the officers involved of ant wrong doing criminally.

The claim which was filed today gives those named until Sepembr 9, 2011 to respond, settle the claim, or face a lawsuit.

I've been following this since day one. A horrible example of police work and warrant service culminating a twenty-month investigation. No charges or arrests have been made against the prime suspect suspected as being involved in the drug and homicide investigation. Nothing was found at Jose Guerena’s house that was of a contraband nature. There is little I haven't documented. Botched all the way.

They should fire the cops, forfeit their pensions and then make each cop involved, shift commander and city manager/council PERSOANLLY liable for civil suit.

Just a bunch of wannabe, donut munching, steroid using, balaclava wearing poser special operators.

Part of the problem is that cash awards alone don't deter police misconduct. The awards are paid by the taxpayers or by the towns' insurance company and then the taxpayers through higher premiums. Unless penalties are directly against the police and city officials, there is no real deterrent.

Yes and no. Usually what happens when a lawsuit is successful the agencies involved and those that are in the area, tighten up their procedures, regulations, operation manuals, etc.

The authorities who send swat teams like this, are gaming. They are upping their chances of removing someone without the obstacles of due process, which in this case would never have led to the death of the accused.
Make it war and you can still kill somebody.
They are gaming and will not be defeated by lawful processes. They find themselves not at fault procedurally, not guilty criminally, and when civil juries make them pay, they pay with taxpayer loot.
