Rick Perry Categorizes Abortion as a States' Rights Issue

ABC News' Arlette Saenz (@arlettesaenz) reports:

Despite holding personal pro-life beliefs, Texas Gov. Rick Perry categorized abortion as a states’ rights issue today, saying that if Roe v. Wade was overturned, it should be up to the states to decide the legality of the procedure.

“You either have to believe in the 10th Amendment or you don’t,” Perry told reporters after a bill signing in Houston. “You can’t believe in the 10th Amendment for a few issues and then [for] something that doesn’t suit you say, 'We’d rather not have states decide that.'”

The 10th Amendment reads: "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people."

The Roe case arose out of a Texas law that prohibited legal abortion except to save a woman's life. At that time, most other states had laws similar to the one in Texas. Those laws forced large numbers of women to resort to illegal abortions.

Jane Roe, a 21-year-old pregnant woman, represented all women who wanted abortions but could not get them legally and safely. Henry Wade was the Texas Attorney General who defended the law that made abortions illegal.

After hearing the case, the Supreme Court ruled that Americans’ right to privacy included the right of a woman to decide whether to have children, and the right of a woman and her doctor to make that decision without state interference.

Is murder a state right?”

Murder is a state crime - always has been. Abortion was a state crime until Roe.

“There is Law and there is morality.

Today we need a moral leader.”

Then you should be fine with Perry, as he has worked to end and restrict abortion in his state. I have no doubt that as president, he would appoint judges who would oppose Roe, and that he would sign a human life act if the Congress sent it to him. Perry is supported by the pro-life groups in his state.

If Perry is such a strong supporter of States’ Rights, then he should remain governor and forget about POTUS.

I also believe a fetus is a human being with the same inalienable rights as I. I also agree that it should not be up for a vote but that ship sailed years ago and it’s not coming back in to port. I’d rather see it illegal in 25 states than legal in all.

I apologize if I haven’t been clear enough up to this point.

Now I know why I prefer Bachmann. ;-)

I like Bachmann too. Unfortunately she has no chance for the nomination, so my dilemma is finding the most conservative candidate who can win.

OK there is no state in the union that has legalized murder (outside of abortion) today. If Roe was overturned how is then that abortion could be legal in any state unless a state decides that the unborn/preborn do not have natural rights?

In 2007 there were 113 co-sponsors (100 Republicans) to the bill H.R. 618: Right to Life Act, which was sponsored by Duncan Hunter. This bill states: To implement equal protection under the 14th article of amendment to the Constitution for the right to life of each born and preborn human person. If we got 113 votes in 2007 imagine how many we'd get now. Turn the Senate conservative and elect a conservative to the White House and there's a lot that could be done with respect to abortion.

One might reasonably ask why he hasn't lifted a finger to stop abortion in Texas, even with a super-majority in his legislature.

He and other supposed "pro-life" Republicans have actually codified the killing of innocent persons in the Texas Code.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the `Right to Life Act'.

SEC. 2. RIGHT TO LIFE.

To implement equal protection for the right to life of each born and preborn human person, and pursuant to the duty and authority of the Congress, including Congress' power under article I, section 8, to make necessary and proper laws, and Congress' power under section 5 of the 14th article of amendment to the Constitution of the United States, the Congress hereby declares that the right to life guaranteed by the Constitution is vested in each human being.

SEC. 3. DEFINITIONS.

(1) HUMAN PERSON; HUMAN BEING- The terms `human person' and `human being' include each and every member of the species homo sapiens at all stages of life, including, but not limited to, the moment of fertilization, cloning, or other moment at which an individual member of the human species comes into being.

(2) STATE- The term `State' used in the 14th article of amendment to the Constitution of the United States and other applicable provisions of the Constitution includes the District of Columbia, the Commonwealth of Puerto Rico, and each other territory or possession of the United States.

That's been the standard NRTL line for decades. But a simple reading of the decision itself puts to rest the idea that the core issue in Roe was privacy. The core issue was the personhood of the child.

Shoot, it's even on tape.

No you’ve been clear. And let me be clear that I believe Roe was a horrible decision and should be overturned. I don’t believe abortion to be a states rights issue but turning it back to the states is 1000x preferable to what we have today.

We just had the most sweeping House win ever and those Congressmen are mocked on the Senate floor by the last GOP Presidential nominee for trying to pass a balanced budget amendment.

The reason abortion was ever legal was because mothers and babies would sometimes die during child birth, sometimes one or the other would live. I guess abortion was terminating a pregnancy when the actual life of the mother was at risk, the actual physical life, but outside that it was not legal.

It's far easier to get abortion banned by organizing at the state level than nationally. If you overturn Roe and claim the baby is a person, who decides who lives if the mother's life is at risk? My point is that is the argument that supporters of Roe will bring up. Do you see this is a maneuver around Roe? It's a smart tactical move and all it does is revert abortion back to what it was pre-Roe vs. Wade.
