The interessting aspect of this case is that she has not yet been charged. There is a preliminary hearing set for August 4th, and the process is that the hearing will review the facts submitted by the prosecution and see if the ingrediants for a felony charge are present. At that time the accused can call evidence and make a statement of denial to the court, and I bet it will be a douzer of a hearing if the prosecution goes ahead. She will undoubtedly raise her constitutional right under the 4th amendment to be free of unreasonanble search without probable cause or warrant, to be secure in her person therefrom.

The TSA never have probable cause, they just assault everyone. This is a violation of everyone’s 4th amendment rights.

*****************
4th Amendment

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

You raise a very interesting issue. If the prosecution goes forward it might force the government to litigate the Fourth Amendment issue. I wonder if DOJ will behind the scenes ask them to drop it?
