EL PASO - A judge has rejected a plea deal that would have resolved Willie Nelson's marijuana possession case in West Texas with a fine, saying the country singer shouldn't get what she considers special treatment.
Nelson was arrested in November after a Border Patrol agent said 6 ounces of marijuana were found on Nelson's tour bus.
Judge Becky Dean-Walker told The Associated Press on Wednesday that she rejected prosecutor Kit Bramblett's suggestion that Nelson resolve the case by pleading guilty and paying a $500 fine for possession of drug paraphernalia.
Dean-Walker claims the prosecutor "doesn't do that for anybody else."
The judge says Nelson should be charged with the misdemeanor marijuana possession, which carries up to a year in jail.

Many of the issues concerning pot are close parallels to those concerning alcohol. Both in sufficient quantity can permanently damage health. Both can fatally react with latent medical conditions (although it would be difficult to outright poison a healthy person with pot). Both in customarily consumed quantities can create intoxication in which a person would be unwise to drive, operate heavy machinery, etc. Both if banned can lead to widespread and even international cottage industries of crime which can turn deadly.
The nation did make a go at banning alcohol and ultimately decided it wasn’t worth the hassle. Even in laxer times, however, many fewer people undertook to smoke pot than imbibed, and there is probably not a sufficient base of potential pot partakers to do more than possibly get marijuana back into the USP. (For those who object to “barbaric” smoke with its irritants and carcinogens, vaporizing equipment now exists.)
But, scout, was it good pot?
There is no good way in current practice to standardize quantities of pot. Some might be about as potent as wilted kale. Some might knock you off your feet at the first puff. Moisture content, which is most of a fresh plant, can vary widely. Some zealous prosecutors try to count mud, dirt, etc. clinging to a pot plant’s roots. On top of these absurdities is the legal assumption, seldom challenged, that if you have a certain amount of pot you had it for the purpose of sharing or selling rather than for your own use. This is obviously not universally appropriate. A legal standard based upon an assessment of overall THC content would be the closest thing to “fair.”
Willie is probably going to insist on a jury trial and THAT will be a circus because who has NOT heard of him? Will likely result in a “slap him on the wrist” verdict at worst.
It is kind of odd to watch all of these anti-big government types advocating putting a 70’s-plus year old man in a cage for possessing a plant. And then they wonder why the government is so big in the first place.

I've never smoked it. I've never even touched it.
Heck, I've never tasted beer, wine, or any alcoholic beverage.
I don't have a religious problem with it and I don't have a problem with other people drinking (except (a) those who drink and drive while impaired; (b) those who drink and get violent; and (c) well, similar cases).
I didn't mix with the right people in high school to be invited to the right parties and my parents didn't drink. When I got to college, I had an interesting first eight days. A high school classmate was killed by a drunk driver while he was returning from the lake. A guy in one of my classes died from alcohol poisoning after chugging hard liquor at a fraternity rush party. A girl who sat almost directly behind me in one of those mega-history classes had her pelvis shattered (and her date was killed) when a drunk driver hopped a curb and hit them as they were walking back to her dorm from the 'free movie.'
And, on the eighth day, my first cousin was driving drunk and broadsided a station wagon with a husband, wife, and three kids inside. I don't even want to go into those details, except to say that happened in 1974 and he's the lucky one. He only has permanent brain damage. You can go and visit him, but the only thing he wants to talk about is the concert he was on his way to attend the day he destroyed a family.
So . . . I decided drinking was not for me. I guess pot and everything else followed as out of the question.

You sound very racist, do you use illegal drugs, is the compulsion so strong that you break the law to keep using because the risk and your criminal acts must be endured for you to continue as a user, even though you probably describe yourself in some situations as conservative, does your drug supplier know that you visit conservative forums? If your supplier did find out, at least you can tell him that yeah, but you push your habit to others at those sites, you encourage drug use to those ‘straights’.
My drug supplier? Why hey, that’s me! You see, you can actually grow this stuff yourself! I know, it’s a real amazing concept that I’m sure is far beyond your grasp.
And I live in Colorado and have this little red card that basically eliminates all the risk, so there isn’t much compulsion there. Not that your little “it must be addicting if some artificial constraint against it is not enough to keep you away from it” argument holds much water. Most people who believe in freedom recoil at the idea of a government entity telling us what we can do to ourselves and will break the law out of pure principle.
But I’m like sure I’ll be out there raping white women in no time, because that’s what pot like does to you long term and stuff. I’m already listening to the negro jazz music (including that smack addict Charlie Byrd Parker), so that’s like the gateway to rape (along with the reefer of course).
