good question. A special prosecuter can be called for by the Attorney General or Congress. Next question is does it have to go to a vote in Congress or can just any congresscritter ask for one? We certainly can’t let Holder assign one.

It seems weaselly to me too, but maybe there is some sort of protocol that the Senate stays out of House business. I wouldn’t worry though. Issa is itching to go after the administration on this for good reason.

Only the Chairman can issue subpoenas, so I assume the same is true for calling for a SP.
