The case of a Mexican man scheduled to be executed on Thursday in Texas threatens to disrupt U.S. diplomatic relations abroad and creates a politically volatile dilemma for Republican Gov. Rick Perry, who is considering a run for president.
Unless Perry or the U.S. Supreme Court intervenes to stay the execution, Texas plans to execute Humberto Leal Jr. at 6 p.m. Central Time for the 1994 murder of 16-year-old Adria Sauceda.
The International Court of Justice ruled in 2004 that the United States violated the rights of Leal and more than three dozen other Mexican nationals on death row because law enforcement officials didn't advise them of their right to have consular access to officials from their home country under international law.
Some foreign-policy experts say executing Leal might have profound international consequences, and the Obama administration last week asked the Supreme Court to prevent Texas from doing so.
Perry, however, has shown no sign of backing down. And the case has thrust the conservative governor into the international spotlight as he weighs an entrance into the presidential race. That introduces politics into any decision he makes about Leal.

The rapist/murderer didn’t mention that he was Mexican, so the cops didn’t know. After 16 years - as long as his victim lived total - he is scheduled to die. I’d volunteer to shoot him, but that isn’t how they do it in Texas. Besides, I’m sure they could make a small fortune raffling tickets for a chance to be the shooter...and out-of-staters wouldn’t be allowed to apply!
He raped, bludgeoned to death a little 16 year old girl, left her naked by the side of the road, with a large wooden stick or post stuck in her privates. He broke international law! He broke all law! What if that little girl belonged to one of us, what if she was Obama’s daughter? I bet he would have already had him executed by now! This crime was in 1994!

Notwithstanding the ICJ ruling, SCOTUS will not stop it unless it can find a reason to do so under the United States Constitution.
Treaties under which the United States is a signatory DO NOT supecede the United States Constitution and there is AMPLE SCOTUS precedent concerning same ...
As long as he got a fair trial, his rights [as defined under the United States Constitution] were adhered to, and there were no trial errors - this is a straight-up 10th Amendment issue [States' Rights].
It won't be stopped, unless Texas stops it ...

No need to panic....Humberto Leal Jr will cease contributing to global warming on schedule. No one will stop it.
Key facts not mentioned:
1. Humberto failed to inform the police, the prosecutor and the court that he as a Mexican national until after his conviction.
2. The legal system never asked him about his nationality because it was against policy to so inquire because asking that question was deemed politically incorrect. In other words, the same people opposed to his exectuion also are responsible for the policy of not inquiring regarding nationality.
3. It’s the responsibility of the accused to request that his government be notififed. Failure to do so constitutes a waiver of the right. Humberto made no such request.
