Obama Raffle Video Not Legal, Election Law Experts Say

(CNSNews.com) – A video of President Barack Obama filmed in the White House and included in a fundraising e-mail sent to supporters is not legal, two election law experts told CNSNews.com.

...According to federal law (Title 18, subsection 607 U.S.C.), “It shall be unlawful for an individual who is an officer or employee of the Federal Government, including the President, Vice President, and Members of Congress, to solicit or receive a donation of money or other thing of value in connection with a Federal, State, or local election, while in any room or building occupied in the discharge of official duties.”

...If the video was filmed in the Map Room, as it appears to be, then there is no question it violates the law, von Spakovsky explained, because it is clearly part of a fundraising pitch, precisely the type of activity prohibited under the law.

“(2) Penalty. - A person who violates this section shall be fined not more than $5,000, imprisoned not more than 3 years, or both.” Also known as a felony. Also enforceable by the FEC which means that the FEC must take official notice of this.

To quote Joe Biden, this is indeed going to be a “big [bleeping] deal.”

The FEC said the issue of illegal gambling over the Internet, for which I filed a formal complaint, did not fall under its jurisdiction. U.S. Code Section 607 does. That means the FEC must investigate and, if the allegation is proven, act on it.

I know this is a painfully obvious point, but if it was George W. Bush who did this, it would be 24/7 wall to wall PMSDNC coverage with calls by Nancy Botoxi for a special prosecutor.

Personally I would not be surprised if Obama were to take a small American flag from his pocket sometime before he leaves office and blows his nose on it.

Numerous states’ attorney generals notified the Obama 2008 campaign that they were breaking the law when they ran this same lottery back then. They said “sorry” and claimed they would take it down but never did.

Bust his arse with lawsuits.

If the republic survives this imbecile, it will be an enormous validation of the genius of the founding fathers who properly restrained the office of President with enough checks and balances to weather this storm.

My guess is a fine. A fine meted out 2-3 years AFTER the 2012 elections. If 0bama is reelected, then the investigation & any fine will be postponed until sometime in 2018
