UN Intervening in Texas Death Penalty Case

In a 2004 ruling, the International Court of Justice determined that the United States was not granting death penalty convicts from Mexico their right to legal assistance by their own country.

Mexico’s legal system prohibits capital punishment and a treaty with the United States forbids Mexican authorities from extraditing criminals to the United States who face the death penalty if tried in states that utilize some method of execution.

However, a 2008 U.S. Supreme Court decision stipulates that the legal support of a foreign government — or governments — is not required in deciding whether to execute a foreign national convicted of a capital offense. The 6-3 majority ruled that state court judges are given the discretion to decide how a sentence is carried out.

That high court decision cleared the way for Texas to execute Mexican citizen Jose Ernesto Medellin by lethal injection in 2008.

However, the U.S. Congress is trying to resolve the conflicting court decisions with legislation. The pending congressional bill — supported by the liberal-left — would require states to obey requirements of international treaties, such as the Vienna Convention on Consular Relations.

You said exactly what I was thinking. When an illegal comes to the US, they get all of our Constitutional protections. Free lawyers, etc. When they break our laws, they then go screaming for the UN to help them, because they aren’t US citizens. Tough shit! If you’re stupid enough to slaughter someone in Texas, you take your chances.

You are exactly right.

When billions of US tax dollars are wasted on foreign nationals illegal anchor babies and social services, every grievance Latino group and treasonous legislator scream for sanctuary cities and not “breaking up families” or “they pay taxes” or “their kids are legal (though, they’re not)” and “they won’t help with LE if they think they’ll be deported.”

They seek legiitmacy with ITIN or ever State/City-issued ID’s and use chain migration to have everyone from down South on the US Teat of America.

Then, thousands come here to sling drugs, kill, maim, rob and commit many other crimes, THEN they are Mexican citizens who require white-shoe lawyers and pounds of paperwork to ensure their “rights” were allowed.

F the UN. US out of that corrupt, loser organization.

The man raped and killed a girl, and needs to pay in the nation he commited such a henious crime in.

You bring up an interesting point, that goes to the heart of something I was trying to explain to a poster earlier today on another thread.

It is the socialist liberal policies that keep illegals crossing our borders. These policies are what Gov Rick Perry and other conservatives are trying to roll back.

Building a fence isn't going to stop them. They tunnel, fly, climb, drive, what ever it takes to get here.

I have always said...if you required ID in the hospitals and if you are a foreign national, your child isn’t American, he’s Mexican, it would start the outflow.

Then the social services need ID.

The E-Verify.

You would have 5 million self-deport in 1 year.

Dems and the Chamber of Commerce need the votes and $5/hour workers, that is why this isn’t happening.

Nearly 80% of Americans favor curbing illegal immigration, it’s not us, it’s them.

Since this is a case where Perry cannot have the legislature do his dirty work (like Sanctuary Cities), Governor Perry will have to let this man die, if he’s still interested in running for President.

The action is a question of semantics. The UN is not intervening, it has no power to intervene.

The UN is meddling in Texas.

you are supposed to ask for consular intervention BEFORE the trial begins. EVERY lawyer knows this who has any level of competence at trial.

This was automatically taken on appeal. He lost. This is a desperation move. where was the UN all those YEARS ago?

is the victim going to be brought back? the family made whole?

Let's take bets...how long will it be before a Perry "basher" gets on this thread (all two dozen of them) and blames the Governor? Probably won't take long!

Yep. I was pretty skeptical about Perry given that he used to be a dem. But given the attacks on FR I have reconsidered him and have been looking him over. His record has had a few bumps in it but nothing I couldn't live with. I hope he runs and let's see what happens.

The interesting twist and background is that the convicted murderer's lawyers say this should be allowed because in 2005 President George W. Bush agreed with the international court ruling that said 50 other inmates should get new hearings on their consular rights.

Hopefully, the actual Vienna Convention does not conflict with the Supreme Court decision.
