Appeals court dismisses nuclear waste suit

WASHINGTON (AP) — The Obama administration has won a legal battle in the fight over where to bury the nation's nuclear waste.

The federal appeals court in Washington on Friday ruled against South Carolina and Washington state, which want to ship radioactive spent nuclear fuel to a repository 90 miles from Las Vegas at Yucca Mountain.

Congress chose Yucca Mountain as the leading candidate for waste disposal. But opponents are concerned about contamination, and the Obama administration said it would not consider the site and would look for alternatives.

The appeals court ruled that it's not an appropriate time for it to intervene in the dispute because the Nuclear Regulatory Commission hasn't made a final decision yet on the Obama administration's move to dismantle the project.

So instead, we have radioactive materials spread haphadardly thoughtout the entire country, waiting for an accident or worse, a terrorist attack. Politics.

Laws passed by Congress and the Constitution don't mean squat. The judges and the bureaucrats have the power, dontcha know?

It’s becoming quite the fashionable trend for courts to defer to Regulatory Agencies....

Ostensibly, it’s because of an alleged possibility of groundwater contamination or some such.

In reality, it’s because having nowhere to store the waste other than on power plant premises tremendously raises the cost of nuclear power, which impedes its development, harms the American economy, helps out 0’s OPEC buddies, and increases the probability of a nuclear-waste-related emergency which he can blame on shadowy business interests.

CONCEPTUAL DESIGN OF YUCCA MOUNTAIN

I live near the Hanford Nuclear Plant in Washington State. For years they have been building the VITRIFICATION PLANT where they will take the liquid nuclear waste and turn it into glass. It is this nuclear glass that was to be stored at Yucca Mountain.

No seepage into ground.

I hate politics. That's all this is.

Because it's very unpopular with NV voters. I believe Sharon Engle was against it too.

The headline sounds worse for nuclear power than what the court actually held — that this was not the right time to consider the merits of the suit..
