Stolen assault rifle found in home of ex-Marine killed by SWAT

Tucson Police confirm that a weapon they found in Jose Guerena's home had been stolen in 2008.

SWAT officers killed Guerena in his southwest side home last month when they went to serve a search warrant.

Investigators say Guerena pointed an assault rifle at officers when they went in the house.

But they were legitimately serving a warrant for suspicion of being part of an armed home-invasion robbery ring, and were met by a man crouching, pointing a gun at them. Hardly the sort of “execution” that people are making it out to be.

Are you totally stupid? Didn't you see the videos of the so called legal serving of the warrant? The knocked and waited 8 seconds or so before breaking in. His wife had seen armed men outside the house and told her husband, he armed himself as would any law abiding citizen who owned firearms(there is serious doubt he owned the rifle, his wife claimed at the time that the swat team threw it down next to him). He was sleeping, woken up out of a sound slumber, his wife tells him armed people are outside. I suppose you would simply let people break into your house without defending it.

This man did NOT fire and it is only their word that he aimed it at them. I have serious doubts about their story and the legitimacy of the weapon he supposedly had, he was an ex-marine he would not have simply stood there had he been armed.

Despite your stupidity this was a massacre of an innocent citizen. BTW, he was not involved in a stolen crime ring, that was BS made up to justify the shooting. He had relatives that were killed about 2 years ago by members of a stolen crime ring after they broke into his relatives house.

The news media printed lies that made it seem like he was some how involved with the people who killed his sister.

Get your facts straight and also realize that all cops are not good people and that swat teams in particular think they have powers they simply do not possess, not legally.

The warrant, btw, was not legal, it did not state the name of the person and place to be searched or what they were searching for. They have refused to release this warrant, the reason? So they could lie about it without fear of being called on it.

One more thing, if this was such a legal shoot, why did they let him bleed out? Perhaps to keep him from talking?

A former Marine , even a crappy one wouldn't "crouch" down and try to defend an unfortified position with his family in the house.

Let me get this straight, a MARINE, doesn't know how to lay down fire when a group is stacked at the entrance.

Cause he's an idiot and after they throw in a flash bang and breach the door, the party is over. He KNOWS that he can't survive a fire fight with 8 or more guys stacked in the doorway and his family in the house providing innocent bystanders.

The next thing they have to do is bulldoze the house to prevent looting like they did in Waco.

The gun was on safety. ....the Po-Po is going to have to find some child pornography on his home computer, a sawed off shotgun, drugs and money.... all stolen from ............. the police evidence lockers...hahahahahahahaha.

It really sucks when you immediately jump to a plant, but that is where we are in the scheme of life. Don’t trust them any farther than I can throw them. And I can’t even pick them up.

Maybe they wanted to keep it for themselves, and then someone with better sense thought to check whether it had been reported missing.

Some of the SWAT bullets struck the weapon. The forensic report from the county attorneys office indicates the weapon was pointed at the SWAT officers.

The picture I saw of investigators recreating the shooting showed him standing up, and I believe they said he popped into the hallway from another room.

Had they used a no knock warrant and flash bang grenades most likely Jose Guerena would still be alive. I'm pretty sure grenades weren't used.

It was an evidentiary warrant. I'm sure weapons were on the warrant since the investigation was for hot burglaries. Even if they weren't, the weapon was produced as part of the homicide investigation.

It isn't going to be fruit of the poisonous tree.

One of the worst parts of the shift in law enforcement in recent years has been the release of statements that would taint a jury pool. It happens on both sides of the case, but the government has the duty to provide the accused with a fair trial. Many times the statements made about the accused can't win in court and aren't even brought up in trial. It is all about the prosecutors making a name for themselves.

An additional point is the way that the article is written. It says a weapon found in the home was stolen. It didn't say the weapon the dead man had was stolen. If you read the whole source piece it sounds to me like this was either an additional weapon or the reporter doesn't know if it is the AR-15 found in the dead man's hands.
