The man was not shot for trespassing.
The man was shot for hurling large rocks and pieces of wood at a federal agent, striking one agent in the head with a thrown object.

At least they got the headline right.

Because this was, undeniably, homicide.

An investigation will determine the nature of the homicide and forward the findings to the local coroner and DA.

That’s how it should work.

Yes it was.
Homicide is simply the killing of a human by another human.
Check.

It doesn’t presume the nature of the killing, the motives or assess any blame or criminal act.

A man was killed, that is homicide. Justifiable homicide, but homicide just the same.

Justifiable homicide? San Diego P.D. always shows up when there is a killing in the city. I remember when some punks came on to man’s property armed with pipes. Homeowner got his gun. There were two dead punks with pipes on the lawn. SDPD came and investigated. Homeowner was not arrested or charged. I think there will be same outcome here.

I live in San Diego County. It’s not uncommon to see a Border Patrol vehicle that has bars on its windows and dents all over its body. These cretins throw any and everything they can find at our agents. And no one can tell me that, even though they may be stupid, they don’t know better.

Hope so.
I’ve not seen them involve homicide into officers having to shoot anyone here in NY before.
That’s why I was wondering about it.
They usually use the term homicide here when they really mean ‘murder’.

Like I said, "nice shot". I'm pretty good with a pistol myself but it sounds like that officer should get a marksmanship award.

A Border Patrol agent shot and killed a man who was trying to enter the country from Mexico Tuesday night during a fight that left another agent injured.

Other reports tell a different story. Three illegals were spotted going through a hole in the fence. Agents caught one who struggled while the other two ran back through the hole. Somebody climbed the fence and started throwing rocks at the BP agents while they were trying to cuff the third Mexican. That guy got shot. One of the BP agents went to the hospital, was treated and released.

Once again bad command of the English language tells a different story than what happened.

From all I have read it should be ruled a justifiable homicide. But the agent will probably still have to hire a lawyer and spend money he earned to support his family so he can prove it.

I don’t understand why they don’t shoot on site anyway.

Every report of such a shooting has always reported they shot them on site AFIK. Taking them somewhere else and then shooting them would get an automatic murder charge against the shooter.

We’ll have to wait and see what Holder and ‘his people’ do with this.
I also expect Mannish Janet to do something stupid.
[Last time someone got shot at the border while chucking rocks, we had to apologize to Mexico.]
I do not trust this administration.
