APNewsBreak: Railroads threatened with lawsuit

An environmental group threatened to sue two of the nation's biggest rail owners Tuesday under a novel legal theory that would classify diesel exhaust as hazardous waste.

The Natural Resources Defense Council sent letters to Union Pacific Corp. and Burlington Northern Santa Fe Railway, saying it will file a lawsuit within 90 days under the Resource Conservation and Recovery Act, which regulates hazardous solid waste disposal.

The notice letter, which is required before proceeding with a lawsuit, cited problems at 16 rail yards across California, from Oakland to San Bernardino.

I hope you enjoy paying the higher food and fuel costs that would result. California is the nations largest agricultural state and has many of the country's oil refineries too.

If liberal judges or EPA mandates it, will semi-truck owners / diesel auto owners be punished as well?

It's already happened. The California Air Resources Board (CARB) mandates Diesel Particulate Filters (DPF's) on semi's operating in the state.

I think it is probably black mail. If the RR agrees to make a “donation” to their cause the lawsuit will go away. The same way Jessie Jackson operates

My wife sometimes complains about the noise of the horns.

Please give your wife my apologies, and explain to her that the horn usage is EXACTLY controlled and required by the Federal Government.

And I mean exactly, the number and length of the blast, the location, the decibels and pitch, the placement of the horns on the locomotive, all regulated with non compliance punished with reprimands fines and suspensions.

Engineers and the Railroad would treat your wife like their own sleeping child, if they had their way, and sound for safety only.

But government knows best.

It is in the works. EPA plans to start going after farmers who put dirt dust in the air as they plow.

These people are morons. All of them.....

I’m in Rochelle, 80 miles straight West of Chicago on I-88. Roosevelt Rd/Hwy 38 goes through town as well.
