An environmental group threatened to sue two of the nation's biggest rail owners Tuesday under a novel legal theory that would classify diesel exhaust as hazardous waste.

The Natural Resources Defense Council sent letters to Union Pacific Corp. and Burlington Northern Santa Fe Railway, saying it will file a lawsuit within 90 days under the Resource Conservation and Recovery Act, which regulates hazardous solid waste disposal.

The notice letter, which is required before proceeding with a lawsuit, cited problems at 16 rail yards across California, from Oakland to San Bernardino.

Sure, now we shut down the railroads. That'll kickstart the economy.

Shakespeare had a pretty good solution in Henry IV...

That'll kickstart the economy.

Well, it will certainly take care of the unemployment problem. Think of all the human convoys carrying goods back and forth across the nation...'course JIT delivery may be difficult to achieve.

Shutting down the primary source of freight transport is a great idea. [/sarc]

You know, if I was a company, I would just avoid CA altogether. I don’t care how many people live there. Less headaches in the long run.

Apologies to the good Freepers who live there, trying to salvage a lost state.

How idiotic. Rail is one the most efficient ways to transport goods.

...under a novel legal theory that would classify diesel exhaust as hazardous waste.

If liberal judges or EPA mandates it, will semi-truck owners / diesel auto owners be punished as well? What about the costs that will have to be passed on to businesses and consumers who depend upon trains and semi-trucks for delivery of consumer goods? How many more jobs will disappear? How about the trains that haul coal to our electric companies - how much will our electric rates accelerate? The enviro-whackos (greenies), are part and parcel of the Obama administration; an administration completely off the rails.

They need to catch these people in nets and drop them in the Pacific Ocean for fish food.

In Addition: such a move would greatly help end the tyranny of coal-fired power plants and bring us all closer and faster to the nirvana of the early 18th Century.

Next up - lawsuit against Midwestern farmers who are polluting with their farm machinery and preventing the glorious return of the buffalo.

These plaintiffs -— and their lawyers -— should be handcuffed, put on a plane and dropped off in remote villages in Africa or Indonesia. Let them live without all of the things they hate or work to destroy: trains, automobiles, incandescent light bulbs (well, any light bulbs), dishwashers, toilets that waste water (well, any toilets) and guns. Hey, they will even be away from that awful Fox News!

Then go back in a month and see if their perspective has changed (if they haven’t been eaten by wild animals that they couldn’t see without electricity and couldn’t shoot without a gun and couldn’t outrun without a car).

I live in a neighborhood that has a lot of freight traffic. We have tracks on three sides and trains go through there night and day. My wife sometimes complains about the noise of the horns. I tell here that’s a good sound. It’s the sound of people working.

I guess these people would have us return to oxcarts and canal boats.

It would be a lot easier than dealing with their self destructive demands.

I wonder how long it will take before Eric Holder announces that the Attorney General’s office is joining this lawsuit?

Some of those trains likely come through my town. Both the BNSF and UP come straight through town, then cross on the West end.

Its time to stop calling them liberals, environmentalists, marxists etc, and start calling them what they are. “Human Extinctionists”.
