Politically Correct Washington Supreme Court Overturns Murder Conviction
American Thinker ^ | June 11, 2011 | Selwyn Duke

In 2007, Kevin L. Monday Jr. was convicted for the murder of Francisco Green and received 64 years in prison. The incident was caught on a 3-minute video recording shot by a street performer, and the footage clearly shows Monday coolly and calculatingly firing 11 shots at Green on a crowded Seattle, Washington, street corner. Thus, despite the reluctance of witnesses to testify, it was an open-and-shut case.

But now the Washington Supreme Court, in an 8-1 ruling, has overturned the conviction and a lower court that upheld it, claiming that the prosecutor used "racist" arguments. What is the supposed problem? While questioning witnesses, veteran King County deputy prosecutor James Konat cited a no-snitching street code in the black community and made references to the "PO-leese." Writes Jennifer Sullivan of The Washington Times:

Maybe this killer's next victim will be a Washington Supreme Court justice.

Question: Can something be "racist" if it's true?

Actually, the correct answer is, especially if it's true.

wow. as bad as things are, things like this show we’ve sunk further than i thought.

sounds like the policeman’s un-PC remarks are the result of experience, not prejudice. and why do the Judges think witnesses to cold blooded murder in broad daylight, won’t testify? it’s a crime to speak the truth now?

reminds me of the NJ police being accused of racism and profiling, for saying blacks were much more likely to massively exceed the speed limit. until it turned out the study was done by cameras, who didn’t know the race of the drivers...

“Maybe this killer’s next victim will be a Washington Supreme Court justice.”

One can hope.

People forget that judges are lawyers who often where defense attorney’s earlier in their careers.

Lawyers are responsible for most of the decay in American society by abusing the system of justice and commerce.

Did you read the opinion? I did.

This guy is almost surely guilty, but the prosecutorial abuse was extremely blatant. While this guy will be convicted in a new trial, what about prosecutorial abuses of this nature in cases wher the accused is actually innocent.

And for your information, the Washington State Supreme Court, is not criminal defendant friendly. In fact, it is just the opposite in almost all cases.

There are two famous -at least in the crimal law area - cases where the SCOTUS reversed by 9-0 votes decisions involving constitutional violations in Washington cases.

Theses cases are Blakely v. Washington and Crawford v. Washington.

In the state of Washington, nothing could be further from the truth, especially amongst the members of the Washington State Supreme Court.

You normal, honest sane people out there ( I am sincere ) have NO CLUE as to how broken, mangled and arbitrary the American “criminal justice” system is. If you did . . .

Did you read the majority opinion, the concurrance, and the dissent. James Johnson is conservative in every area except driminal law where he couldn't care less about the constitutional rights of an accused.

I follow the WASC VERY closely and all but one of the justices would know me by name. The judiciary of Washington is very corrupt.

Instead of harassing the defense’s witnesses about this “omerta” or “don’t snitch” why could not an expert witness, preferably black, be brought to testify about “don’t snitch”?

The point is that there was nothing wrong with what the prosecutor did. It is a FACT that that code exists in the black community. Only idiots are unaware of it.

And if you’re that close to these justices, I have to wonder about you.

Based on personal knowledge, they are all corrupt as hell.
