A California man who initially claimed to a local television station that he was roughed up by "SWAT team" members who allegedly battered down his front door to execute a search warrant related to his estranged wife's unpaid student loans was targeted due to an ongoing probe into alleged financial aid fraud.

Local law enforcement officials have thus far not commented on the Stockton man's claim to ABC News 10/KXTV that he was grabbed by the neck and placed in handcuffs in back of a patrol car for six hours as his three children looked on during execution of the search warrant on Tuesday.

So they had enough evidence for a search warrant but not an arrest warrant.

And they need a SWAT style search for someone they didn't even have enough evidence to arrest?

Probable cause doesn’t translate into SWAT (or like) Team warrant service. This situation was in no way “hazardous”, nor was any proof of probable hazardous circumstances offered.

It’s about you being WRONG about the cop on another thread and abandoning that discussion when corrected while at the same time reverting to ad hominems and fallacies on this thread in an attempt to claim victory.

What do you have to say about that NEGLIGENT cop KILLING his K9? Why can’t you admit you were proven WRONG after you came rushing to his defense?

It is ok for them to issue a warrant. The problem is how it was served. The ‘guilty until proven innocent’ approach you like doesn’t sit well with me - nor would the Founders have thought much of it, either.

Every totalitarian government issues 'warrants' from controlled courts and agencies. Witness the documentation mountains uncovered in the NAZI archives, the Argentinian archives re: the 'disappeared' ones, even the Soviet archives.

Since the Nuremberg War Crimes trials people wondered, "why would any one diligantly document and film such heinous events"?

Some years ago a German documentary about the Holocaust asked that question. The answer from a minor soldier in the SS was revealing. Paraphrasing his reply, "we did not consider ourselves murderers, much less monsters. We had sworn alligiance Hitler,to the country, to our officers, we followed legal orders."

There is plenty of video on the internet of the self-documented perpetrators and their crimes. Again from the German language documentary; a short film of concentration camp guards stagger drunk, dancing little jigs, throwing up, all with the most haunted expressions I've ever seen but for those of the camp victims themselves. The narrative continued describing how many of the camps guards sought transfers to the front, that extra ration of alcohol were issued to drown their internal horrors.

Try reading "Flyboys", a recent book about US aviators in the Pacific theater battling the Japanese. In accounts by the American POWs and their Japanese captors you'll read about Japanese officers, as heavily drunk as their German counterparts, demanding that junior officers behead their living prisons while assembled grunts witnessed the event. The officers then demanded the unit medical officer remove the livers so that they might be cooked for the officers mess that the livers fortify their sense of Bushido.

Warrants, mass arrest orders are all necessary for the execution of even tyrants demands because the average man of a civilized culture requires a command to over come his inherent reluctance to cold blooded murder a member of his own species. And even then is not free of the justified guilt, the mark of Cain, that he allowed himself to wear.

But there are those sociopaths that discovered the release of constraints on their darks hearts, they love that stuff and literally eat it up, as I pointed out.

On a personal, I'm alive because of an error on the Soviet occupiers round up orders when they invaded his country for the second time.

My grandfather, a former Latvian Rifleman officer, a POW of the Germans in WWI,fought the Reds in the Russian Civil war, and the Soviets in their first invasion, had moved from the original list provided by Soviet fifth columnists.

Imagine that, a wrong address on a 'properly issued' legal arrest warrant containing a mistake. Our family found out because an old friend of my grandfather had sifted through the available archives that were opened with the fall of the Soviet Union.

I leave you with no desire for a response from you or any of your cohort on this thread. If you're a true conservative, you'll understand. If you're one of the wannabee liver eaters, let me suggest you put a plastic cover on your photo of the burning Waco 'compound' to keep it dry.

Uh huh, typical of your ilk, if I dare to think differently than you and your own personal interpretations of the law, then I must be silenced. You can’t have anyone challenging your view of reality now, can you.

You don’t know me. You don’t know what principles I hold to. You just make a blanket assumption based on your own preconceived notions of what should be happening in the world, all without having all the facts.

Why don’t we lay it out on the table for all to see. Cop-hating has never been a conservative value. It has been a fundamental goal of communists and socialists since at least the 1950s. During the hippie movement of the 60s, hating police became all the rage. As liberaltarians infiltrated the Conservative movement, they brought their socially liberal filth with them (homos, drugs, abortion, adultery, fornication, perversion, pornography, libertine mentality), and then in turn injected cop-hating as a virtue.

The reality is, the police are an essential component of a free republic. Hence the involvement of folks like Benjamin Franklin in organizing professional police forces. Society cannot function without some measure of order and control. Socialists and communists want to break down law and order to effect revolution. Look at every communist uprising in the world, and you will first see chaos preceding the violent overthrow of government. Socialists used to pass out pamphlets attacking the military and police as the building blocks for sowing disorder and violence.

I find it hypocritical that the libertines here will make blanket statement above law enforcement officers so that they can push their agenda, but the very same people will claim to worship the ground that soldiers in the military walk on.

The fact is, many law enforcement officers, and MOST on SWAT teams are former military or current national guard/reserve military. Yet it seems as soon as they switch uniforms, they magically become a tool of oppression.

The majority of law enforcement officers are conservative, down to earth people that believe in law and order. Most have an overarching sense of commitment to service. Most have been involved in serving, both in the military and as police officers for their entire careers.

Yet it is becoming all the rage to hate the police but love the military, never mind that the criminals who walk among you will gladly kill you, rob you, rape you, or steal from you in a heartbeat when law and order breaks down.

Oh wait, I know... everyone here is Rambo and will just shoot up the bad guys in a heartbeat with their gun collection when law and order breaks down.

The reality is, when society degenerates to that point, you won’t do nothing other than cower in a corner waiting the inevitable, because there will be far more of them than there will be of you. Perhaps you want to live in a Mad Max: Beyond Thunderdome reality, but the majority of individuals do not.

I just can’t stand seeing conservatives used as pawns by communists, socialists, liberaltarians and the media, who are committed to destroying the moral fabric of our society, and seeing law and order break down on a whole-scale level.

The very same people who are pushing the cop-hating agenda, rabidly support destroying the traditional family, abortion on demand, drug use, pornography, and the removal of God from the public sphere.

Have you read the other stuff on CATO? Have you read the libertarian party platform?

Let’s put it all out there... what do you believe about Abortion? Same-sex ‘marriage’? Pornography? Adultery? Fornication? Drug use?

The probable cause used for the search warrant is not the same as the probable cause for an arrest warrant. Essentially, the affidavit necessary for a search warrant needs to show probable cause that a crime has been committed and the place to be searched is likely to contain evidence of the crime.

For an arrest warrant there needs to be a showing of probable cause that a crime was committed and the person to be arrested committed the crime

I found a copy of the search warrant on the internet, but the internet copy did not include the affidavit in support of the warrant.

That simply isn’t true. There was no probable cause standard for warrants in Nazi Germany or the Soviet Union. If the government wanted you gone, they could make you gone with a flick of the wrist. There was no due process, no court system, no trial, no review by judicial officials.

As for Waco. Waco was a botched operation that was horribly planned. The Texas Rangers could have and would have handled it properly, but were told to stay out of it by Reno and the ATF. However, Waco is irrelevant, as this wasn’t Waco.

I would say that 998 is either a badge number, radio car number, or as it is in some jurisdictions, both... But that is just a guess on my part.

I'm still chucking about the use of the phrase "rock solid PC". Rock solid probable cause is something akin to "genuine imitation leather" when you get in front of a good criminal defense attorney.

Look... The law enforcement community is just like any other community: it has its dregs, criminals, and bums, too. Anyone not wiling to admit that is willfully blind and will usually fall victim to that which they chose not to see, either from being a victim of it or getting caught up in it themselves. I'm not going to paint all cops with the same brush... But when I witness some of the "just cut their switch off" (IOW: pull the trigger) antics by certain LEOs that I have seen on the range, I'm left to wonder how they got past their psych evaluation... And I've guys admit to me that they are a member of the SWAT team for the pure adrenalin rush. One once told me that he (paraphrasing to keep it clean) "got aroused every time his SWAT pager went off." That is sick...

Let’s say he’s a dirtbag fraud, does that mean it’s ok for the DoE to send paramilitary federal agents to rough him up and ransack his house in a SEARCH for evidence? Was he armed? Stockpiling? Resisting? A known dangerous offender? Holding a hostage?
NO.
Give them this sort of power, and they will use it on the “innocent until proven guilty” every time, and among those will be the proven innocent.
It does not matter if he’s likely guilty. He is not to be treated as guilty.
Shame on you all who say the US govt is justified to send storm troopers to execute a search warrant on a citizen entitled to the presumption of innocence.

I doubt it. You’ve got to factor in days off, training days, sick leave, vacation, and extra days off. Some of them will be traffic guys on motorcycles or cars working collisions, etc. If a “management officer” is a supervisor, and doesn’t include detectives, then out of that 275 you have to subtract detectives too boot.
Point being that there were probably a lot less than 80 to 100 cops available unless they pulled some in on OT.

My point is that there is no indication that anything more than a regular service of a search warrant was needed?

Without enough evidence to arrest someone - why the need for a “dynamic” entry?

They thought he had a hundred shredders ready to destroy the evidence within a couple minutes?

Increasingly LEO’s are using this type of “raid” on American citizens with the slightest of pretext.

In this case there doesn't even seem to be the pretense that he was dangerous or ready and able to rapidly destroy the evidence they were going to search for.

I cite the Soviet mass arrest order/warrant with the wrong information, wrong address, and allude to the BATF Waco arrest warranty, that in fact had listed demonstrably untrue reasons by agent IIRC Aquilla. Which is at the heart of this tragedy.

But you keep feeding back:

There was no swat team.
Now there was no history

Wonder what flags fly deep in your heart? They sure as hell aren’t American ones.
