Kathryn Johnston, an elderly Atlanta woman was gunned
down in 2006. There’s a Wikipedia entry and several
articles at Reason magazine. This raid murder was unusual
in that the Atlanta officers involved were fired and
prosecuted. November 2006, at his site The Agitator,
Radley Balko posted “Context for Kathryn Johnston” wherein
he relates several other victims in such raids, one of them
an 8 year old boy.

The guy named Storie is the lawyer for the SWAT team members, and he did say that no one would have been arrested IF blah, blah, blah. I believe the Sheriff’s department spokesperson said the same thing, but I do not remember his name.

They were raiding DRUG DEALERS. Trying to clean up the neighborhood. Jose had been making calls to the police about local drug houses and been ignored, investigated, and put on 'the list'. (what's the list? It's one every PD has with people on it who have pissed off the cops, and are to be harrassed when encountered). Jose's COMPLAINTS to the PD are even on record.

That's the first time I have seen that. Where did you see it?

The high yesterday was 46. Today it got to 64. Forecast of mid 70s for Tue and Wed the first 70s of the year.

It’s been in the 90’s here.....and the water is just right.....LOL

Our water is just right too. Two degrees above freezing so it IS water rather than ice. LOL

I can do without 90s but some 70s will be mighty welcome. Coldest spring here in many years.

I don’t give a damn if the PIMA County sheriff is a good old boy and a conservative. The Bill of Rights still applies.

IMO the whole thing comes down to unreasonable use of no-knock warrants and SWAT teams. They should only be used where life and limb are in immediate danger. This case falls far short of that. He could have been detained during or after his 12 hour night shift at the mine where he would have been unarmed and dead tired. His wife and two young children could have also been detained after leaving the house with the added benefit of using the opportunity to ask her if anyone else was there.

This was the epitome of lazy, sloppy police work that apparently didn't employ even the simplest surveillance or background research before conducting a half-assed dynamic entry. If you have seen the video of their entry I think you'll agree that they aren't trained well enough to handle a barking dog call.

There may be ‘cop-haters’ on FR, but I see the articles posted not about police, but about police abuses, the laws that abuse our Natural Rights, and the cover-ups of such abuses.

That’s the real problem. There are bad cops and bad laws and good cops and all good people should be against them both, no?

I suppose one should then assume that JOSE did not complain to police about his relatives and their children getting killed by HOME INVADERS.

Here is what is known about previous 'arrests' : "Jose Guerena, a U.S. Marine for six years, did not have a criminal record in Pima County and his wife said he worked the graveyard shift for Asarco."

"Alejandro Guerena, 27, had contact with local law enforcement about a dozen times and was found guilty of misconduct involving weapons in 2009 and possession, manufacture, delivery and advertisement of drug paraphernalia in 2006 and 2005, records show. He served some time in jail, but records are unclear as to when and for how long."

"Jose Celaya was arrested by the Drug Enforcement Administration a couple of years ago, but the circumstances are unknown."

The Police say that Guerena and family were involved in HOME INVASIONS.

Then why would they INVADE the homes of their OWN FAMILY and KILL THEM? Does that make any sense to you????

Why is it that the family of GUERENA that was killed in a home invasion, did not involve drugs?

As far as the facts go, All the PIMA County SWAT Team is revealed as a mobile firing squad.

This has lead to another Ruby Ridge. Even if the killed suspect was reealed to have the sunject of the search, he did not deserve to die by firing squad. This is incredibly wrong. A no knock search warrant became a warrant of summary execution by firing squad, IMHO.Its like handing out a traffic ticket to someone and then pounding the pi$$ out of them because the officer thought they were dangerous , a gross over reaching using due process as an excuse.There is no excuse for those who are supposed to be trained professionals.

Inside his own home that man had a right to stand there with his rifle.

If I lived in Pima County, I assure you I would have double half inch steel doors with steel girder support frames, front and back.No ID, no entry. It appears that the SWAT personnel are just as murderous as the drug gangs in this case, both are to be feared by ordinary civilian Americans. AND for good reasons based on straight fact.

Legalisation would result in mass layoffs at the DEA and the ending of no knock drug raids that result in the deaths of innocents.

But would result in a mass increase at BATF and with all the extra $$ coming in a tremendous expansion of government.

Garbage. If it's taxed and regulated like alcohol it should be no more difficult to enforce than alcohol regulations.

You comment on legalization, but you avoid my question on the constitutional basis for current laws. Asking yet again...

Do you think the original Commerce Clause authorizes fedgov to impose national drug and alcohol prohibition... YES or NO?

I just got back from an hour workout with weights while walking two miles, then push mowed the back yard. It does help. Even the COPS say this 'raid' was based on recent HOME INVASIONS, involving DRUG HOUSES. Why would he raid one of his relative's house and kill his cousins and children?

Why, if they were pushing drugs were there a very limited of drugs found between all 4 or 5 houses? (some pot in the oven)

WHY were the COPS raiding the Guerena family homes, and not the DRUG HOUSES? Apparently everyone, including the cops, knows where they are.

The Sheriff didn't want WELL TRAINED, and EXPERIENCED SWAT TEAM guys conducting the raid.

That is why it was made up of mostly rookies from various SWAT TEAMS.

He didn't. I do believe I read that he and his family had complained to police, and that the police were hassling him and his 'family' but I cannot find that reference.

Several of his relatives were killed in a home invasion, in the very same area that this raid took place. Of course, the PD says they have no leads, no witnesses, no suspects.

Does it appear to you , based on the information we have, that the members of the Guerena family were involved in dealing drugs?

Why would some drug dealer with $94,000 in cash laying around (at his cousin's house) bother working 12 hour shifts in a copper mine at hard labor ???

(maybe he sold $94,000 worth of pot to the miners....)

If members of your family were killed in HOME INVASIONS, which the police were doing nothing about, what would you do?

If you decided to take the law into your own hands, what do you think the cops would do, especially if they were receiving protection money from the drug houses you RAID ????
