Pima County Sheriff's Department today responded to the controversy surrounding the death of a man shot and killed by deputies earlier this month.
Attorney Mike Storie says that contrary to what the Guerena's wife's attorney said, the SWAT team made it very clear they were police and they were there to serve a search warrant.
Storie says they used lights and sirens, and eventually pounded on the door for about 45 seconds before going in. Once inside, Storie admits the victim did not fire at the SWAT team, but he says the victim's actions still warranted the response that law enforcement took.
Storie went on to say the items found inside the home help prove these allegations - PCSD found several weapons, drug material and even equipment similar to police uniforms that he says could have been used to raid drug houses posing as police.

70 shots at one man that NEVER fired at them can not be justified by any means..........
FAILED................

Jose Guerena, 26, former Marine

Here is the man's grieving wife, Vanessa Guerena. They have two sons, ages 4 and 5.
I wonder how many defenders of this SWAT action supported Murtha’s assault on the Haditha Marines.
14 days, well it takes time to put on several coats of white wash and Ratherize the documentation. When they get down we will find out that the guy they killed would make OBL look like a commom shoplifter.
I do not believe this! There is a cover-up happening here big-time, imho.

It’s infuriating!
I’ve seen reports that say that the neighbors NEVER heard any sirens or saw any lights. My instincts tell me that this is a major FUBAR and the PCSD is in full damage control mode. Planting evidence after the fact would not surprise me.
Shiite! C’mon the guy works a graveyard shift in a mine? Just the MO for an organized crime gang member. I call BS.
45 seconds? That’s a long time. Yeah right, leftist liars, we believe you.
We’re living in a police state, not only this but Indiana and later SCOTUS. Things were bad enough before. Not much left of the republic.
That would explain all the lying and obfuscation on the sheriffs departments part.
If this isnt a good enough reason for everyone to have a camera and recorder at their front door I dont know what is. Why have the warrant and affidavits not been released yet?
Yeah, that is why rulings like “just lay back and take that Police intrusion without a warrant - it will be sorted out in Court - you have no right to resist” and the “no knock raids” and the tendency of SWAT to shoot first (second, third, fourth...seventy first) and ask questions later have GOT to be looked at.
A citizen has no idea if the people breaking down his door are criminal Police, criminals posing as Police, or Police acting in legitimate furtherance of their duties (but perhaps with a wrong address and they are going to shoot your dog regardless).
Re: the alleged clothing...
It could be old military uniforms, it could be Halloween costumes, or most likely of all, it could have been planted by the leftist Pima County jackboots.
What were they doing in all that time?
Gardening - like in planting.
This stinks to high heaven.
TAlk about a biased news piece - it never mentions that this man was a MARINE VET - OR that he worked in the mines...(sounds like a really bad guy, huh?) Or that his wife heard noises and saw men looking through the windows - and screamed for her husband to wake up = there were men coming in...sound like they announced who they were? Ask yourself, why do they leave ALL this information out?
If there were ANY justice at all in this country, ther’d be a BIG tree in that town so loaded up with perps it’d lok like f’n wind chimes.
I’m sorry to have to agree with you. As of today, I’ve made a promise to myself to be certain that my 21yo son is aware of the scenarios he may be facing in the future.
And yes, 45 seconds is a VERY LONG TIME! Long enough for police to show proper ID and paperwork.
Death by shooting squad without even a trial. Just what they gave him.
No. That’d be too quick. These bad dogs need to suffer for their evil deed.
