Republican opposition is steadily growing against controversial University of California-Berkley law professor Goodwin Liu, President Obama's nominee for the Ninth Circuit Court of Appeals, potentially imperiling a judicial appointment for the first time in his presidency.
Senior Republicans launched an all-out push to quash the nomination, urging their conference colleagues to support a GOP-led filibuster.
"(Liu's) record reflects a carefully honed and calculated philosophy that he developed and advanced over the course of his brief career in the ivory towers of academia and which threatens the American tradition of limited constitutional government," Sens. Charles Grassley of Iowa, top Republican on the Judiciary Committee, and senior panel member Jeff Sessions of Alabama, wrote in a letter, obtained by Fox, to their GOP colleagues Wednesday.
In a most ominous sign, former GOP members of the so-called "Gang of 14," who narrowly averted a judicial crisis back in 2005 that nearly shut down the Senate, are lining up against Liu, as well.
The somewhat undefined threshold developed by the bipartisan group back then stated that a nominee should be filibustered only under "extraordinary circumstances."
"The nomination of Mr. Goodwin Liu does rise to a level of 'extraordinary circumstances,' and therefore McCain will seek to filibuster the nomination," read a statement by the office of former Gang member John McCain.
[snip] Democrats need at least seven Republicans to keep the Liu nomination alive, but their GOP possibilities are fading fast.

Ah, yes, the ever-popular Ninth Circus Court of Appeals. This guy would probably be considered the right wing element of that judicial POS.
I had wondered if that whole Gang of 14 agreement was a factor. Those senators, of both parties, said filibusters would only happen in “extraordinary circumstances”.
I hope the filibuster holds. It will send a strong message to Obama about his liberal radical judicial nominees.
If there are any more Supreme Court vacancies during Obama’s term, that could be a big battle. There was no major opposition to Sotomayor or Kagan, but yet another radical liberal appointee to the Supreme Court could spark a big battle.
Congress should just dissolve the Ninth Circus and start again. They have the power.
I think many see it different too when you are just replacing a lib with a lib vs. the chance to remake the court.
I think even the moderate GOPers will support a filibuster if a conservative were to leave the court during Obama’s tenure.
JUST SAY NO AND HELL NO TO OBAMA!!!!
not nearly enough the way I see it, They Should be Removing Corrupt Judges on a Daily basis, just hold the Impeachment Hearings, bring out the corruption for all to see, and if the Senate refuses to go along, they do so at their own peril.
Uh. Don’t plan any celebration dinners.
COOL! A SECOND COMMUNIST "LIU" PURGING IN MY LIFETIME!!!
While I applaud the effort, it’s a little like locking the barn door after the horse has been stolen...
They let Sodamayor and Kagan breeze through - two flaming liberal communist douchebags got on the Supreme Court, and now we’re stuck with them until they stop breathing.
So, yeah, GOP, thanks for standing up to this latest liberal moron, but it’s a little late...
Given the number of judges that were filibustered after that agreement, and how much more radical and unqualified Liu is then most of those judges, it's about time we filibustered a judge.
When
If this guy passes, I will stay home on election day....
WOW! A vertebra!
We need direct election of Federal Judges.
That’s the - how shall I say this - least wise thing I have heard in a long time.
I disagree.
Look at all of the $#*@! morons that are elected today. You want to give idiots like that a lifetime appointment to the federal bench?! I don’t think so.
The number is a fraction of the number of *&%$ political hack morons who are appointed today. I'd trust the electorate over hack pols any day.
Cloture vote is supposed to start at 2:00 PM EDT. A failed cloture vote does NOT kill the nomination, it preserves it. The only way to kill it is to have a majority of Senators outright vote NO to an advice and consent vote.
