ALBUQUERQUE, N.M. -- A special type of government search warrant that allows authorities to search homes without informing the owner for months is becoming more common, Target 7 has learned.

/snip

The number of delayed-notice search warrants spiked nationally from nearly 700 in fiscal year 2007 to close to 2,000 in 2009.

A search warrant is for the seizing of evidence.

A secret search warrant and no witnesses will mean planted evidence in very short order.

Something is rotten in Denmark as the old saying goes. If you aren’t guilty when they start, you will be by the time they finish.

Really? Please read the following, and tell me where you see the constitutionality of unnotified, secret searches:

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated

It's a recipe for fishing expeditions and planting of evidence to destroy political enemies. Might even be pretty lucrative to do so if they just want your house, civil asset forfeiture and all that.

You left off the other part:

...shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

There's a warrant. I don't see how this RICO provision violates this amendment.

As I said last night in a similar thread; if this becomes the law of the land, the numbers of LEOs who die in the line of duty is going to grow by leaps and bounds. All the home owner will say is: “Wow, that’s too bad...I thought it was an intruder...” Two can play this game, and it will be Law Enforcement who loses.

This is a horrible error in judgment by the Court. They will be responsible for the increase in LEO deaths. Very sad indeed.

The ACLU doesn't care unless it's a Christian group with a nativity scene or a cross somewhere.

They are so full of BS. They are probably overjoyed that 4th amendment is being destroyed.

Here’s how you deal with this...

1. Overt video and audio recording on a UPS.
2. Covert video and audio recording on a UPS with offsite recording.
3. Alarm system with audible alarm on UPS.
4. 4 legged furry land sharks.
5. Good, very good locks.

Catch them at their own game. Expose them to the media and publish the video.

The citizens of New Mexico need to be making a LOT of noise about this.

All branches of government and all levels of government need to be properly checked and balanced.

Right after the Patriot Act became law my doctor was panicked, and asked me what I thought. I told him with Ashcroft as AG I wasn’t worried too much, but I hated to see the Democrats get a hold of it. The best policy is to not make laws tyrants will use against you, but we have, and he is.

I thought about this when the Patriot Act was being debated. I was and still am against it.

Those are powers you don't want in the hands of a conservative administration and ones you really, really, really don't want in the hands of statist Dems.
