ALBUQUERQUE, N.M. -- A special type of government search warrant that allows authorities to search homes without informing the owner for months is becoming more common, Target 7 has learned.
/snip
The number of delayed-notice search warrants spiked nationally from nearly 700 in fiscal year 2007 to close to 2,000 in 2009.

One, there are way too many FReepers who believe that LEO's can do no wrong. But do you have any idea what kind of person becomes a cop in today's environment?
2. Look at the spike in 2009. Who became "pres_ent"? Who was Gov of NM?
My point: the pendulum swings. What we allow a GOP Pres to do unconstitutionally means the next time we have a Marxist loser Prez (which is going to happen) he can do it to0.
Flame away.
No flame here.
I thought about this when the Patriot Act was being debated. I was and still am against it.

I just can not understand why more people don’t realize that the Constitution and especially the Bill of Rights was conceived for the main purpose of protecting the citizens from our government and especially and specifically from the law enforcement agencies.
We should never trust any LEO or the agency for which he works to protect our legal rights.
We must protect our rights by insisting that the Constitution be followed to the letter.
Neither drugs nor terrorism should make one bit of difference in the way the Constitution is interpreted, for it is not about drugs and terrorism. It is all about human nature and the natural desire of those in power to control those not in power.
It’s time to repeal the Patriot Act. There’s nothing patriotic about wiping out constitutional rights.
It's way past time to start shooting back.
Bastards, the whole lot of them.
Its supposed to be used for terrorists. I’d guess about 5 of those 2000 were for something other than terrorism.
Yeah, I know what you mean. It’s almost like the American people are going to have to fight to regain their rights all over again. Damn these totalitarians and the cops they rode in on.
Agree 100%. No flames.
If it was okay under Bush, certainly, its ok under Obama.
Right?
Honestly, anyone who thought it was ok under Bush needs to have their head examined. Unconstitutional acts are never ok.
Nope.
PA II should be allowed to die.
LEO had and has all the tools they need to prosecute without turning a law into a device for destruction of US citizens life.
Where is the ACLU on this?
It's only fair.
This isn’t new, and it’s not from the Patriot Act. It came out of RICO. I don’t think it’s unconstitutional. RICO laws have been pretty well tested by now. They still have to get a warrant, they just don’t have to tell the subject that they were there.
Plotting with Islamists.
lol. Delayed notice warrants. That’s funny. Sorta like post-coital consent.
Exactly... this act was depicted in the Sporanos... and the FBI entered Tony’s home without notifying Tony that they had planted mics and cameras. They did have a Warrant to do so.
LLS
This doesn’t add up. They have enough to convince a judge to issue a warrant but just look around and take photos? Doesn’t pass the smell test. A search warrant is for the seizing of evidence.
Really? Please read the following, and tell me where you see the constitutionality of unnotified, secret searches:
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated
It's a recipe for fishing expeditions and planting of evidence to destroy political enemies. Might even be pretty lucrative to do so if they just want your house, civil asset forfeiture and all that.
It's just a matter of time.

Your thinking is sound, but you forgot that the very government is the keeper and maintainer of the Constitution — they can bend, twist, abolish and destroy it any time they want. Just look what is happening today.
You can only theorize and vote, hoping that your ballot will elect someone who will assure the Constitution’s survival, but it is not a certainty that it will. Especially not with the crowd in power and the spineless opposition.
