Police Investigate Ind. Supreme Court Threats After Ruling

INDIANAPOLIS -- Capitol Police in Indianapolis are investigating harassing phone calls and email messages to the Indiana Supreme Court following a recent contentious ruling regarding property rights.

Police won't say how many calls and messages have been received or whether they're addressed to a specific justice.

Court spokeswoman Kathryn Dolan told The Times of Munster the threats are mostly directed at police officers. Quantcast

The state's highest court ruled Thursday that Indiana residents have no right to resist police making an unlawful police entry into their homes.

In a 3-2 decision written by Justice Steven David, the court ruled that people confronted with an illegal police entry into their homes should allow entry and sue later for damages.

It said resisting entry increases the risk of escalating violence. The decision overturned centuries of common law.

"We believe … a right to resist an unlawful police entry into a home is against public policy and is incompatible with modern Fourth Amendment jurisprudence," David said in the ruling.

Apparently only half and both paternal GPs were Christian, which means they likely saw the writing on the wall and got out while the getting was good.

Still, getting support from Zogby is not the way to Tea Party conservatism.

Since when does a state court decide that the Bill of Rights no longer applies to citizens in that state? This would never happen in Texas.

Yep according to this ruling resistance is futile as the saying goes.

But it gets worse. How about a corrupt cop (and we know they are many). Say a corrupt cop eyes your daughter and decides he’s going to get some and comes knocking? You’re not allowed to resist, you have to let him in. I guess AFTER the girl is raped you get to take it to court.

Don’t think so. This ruling is actually going to CREATE violence not stop it.

Futhermore, this kind of ruling or action is exactly the same thing that kicked off the Revolution via the ‘Writs of Assistance’ vis a vis the Paxton Case (Writs of Assistance were illegal searches passed by Parliament in 1761, challenged by 63 Boston merchants led by a merchant named Paxton. John Adams would later call this case the “Birth of Independence”). Folks, history is repeating itself.

We either start rising up as one people fed up and will take no more, or our liberties are gone. It is too late for anything else, we have passed the rubicon. Who will lead us?

I guess "modern" means "voided". Sort of what they've done with the 1st, 2nd, 4th, and 10th amendments.

Making threats is stupid. Remaining silent while taking action isn’t.

you are 100% correct. I've always thought that all it's going to take is one former Ranger, Force Recon, SEAL or soldier with training to get killed or family member killed for someone to start "inviting" the police to raid their houses.

I'm pretty sure that if some donut munching, ninja, wannabe special operator wearing his little balaclava killed a family member of mine...................

I'd take them to court and find a really good lawyer for years of litigation and to insure the rights of the police are covered and he doesn't lose his pension or his worker's comp disability scam.

Cause violence is NEVER the answer.

   You break in my door, you are going to catch a face full of double barrel buckshot.

  Buckshot is actually covered by the 2nd Amendment, and no one has actually repealed the 4th Amendment, so you should be OK. At some point, Americans really do have to assert their rights. It's like a learning experience for the would-be tyrants.
