If Obama issues his unconstituional EO and a company disregards it, Obama would need to take the company to court in order to enforce it... I don't think that is correct. Since it would be an EO and not a law, it only applies to Executive branch agencies. He would simply direct those agencies to not do business with any company that does not report.
It would be up to the company to take it to court as a restraint of trade issue I would guess.

You’re absolutely right; my mistake. I guess that the issue would get to court if a company sued the agency for discrimination or restraint of trade or whatnot, or if someone at an agency was reprimanded or fired for continuing to do business with a company that wasn’t complying with the EO.

Since when does congress or the constitution mean anything to Obama unless it’s to his advantage? They are an afterthought at best. Both are simply barriers he works around, thru, and over at will...just a matter of getting his legal ducks in a row to cover his behind, and then he considers how long it would take in the courts if there were a protest and how much he can get underway til it won’t matter.

It’s another version of pay to play, only this time it’s in reverse.
Obama is betting that the companies will decide not to contribute to Republicans or to causes that are in direct conflict with their own interests, like Right to Work legislation. I’m betting that the companies are desperate to get rid of Obama as quickly as possible and will donate even more.
