That's just silly.
It was clearly a first degree assault.
The victim was treated for cuts and bruises and released from the hospital the same night he was admitted. Under no possible interpretation of the statute was this even close to "attempted murder."
An adult man trespassed into a women's restroom, pretty predictably starting a fight.
I'm sorry, but a grown man who barges into a women's restroom and refuses to leave is asking for a beating.
If this had been a guy wearing jeans and a flannel shirt insisting on entering a women's restroom, and if he had gotten whupped by two teenage girls, those girls would now be folk heros.
One stomp to the head can be deadly, to a person already on the ground.
The attackers were viscious. They were outside the bathroom. The attackers were not in any danger. The attackers came back and continued the attack and were clearly overpowering the victim.
That, and attempted murder. This person could have easily sustained life-threatening or fatal wounds from this attack.
