I don’t care what some demented group of legislators have to say. They could declare the guy was a mongoose, but it doesn’t make him one. Moreover, it is likely that no state constitution actually gives the power to legislators to declare men are women or women are men. Of course, the judges and legislatures are now just making it up as they go along (the Goodrich case is an example), so I suppose that it doesn’t matter what attempts were made in the past to limit government power. What is concerns me most, however, is the legal positivism implicit in your comment.

You can be concerned about whatever you choose. My eyes were opened when I realized the reality of the situation. while I do not approve of men using women’s rooms or even of sex change operations...I now understand that the person seeking the operation has no choice in the matter. If that individual wants to qualify for the operation, that individual is REQUIRED to change his name and use the lady’s room for at least one year BEFORE getting the operation.
You can blame whoever you choose. But you can’t logically blame the individual that uses the lady’s room as he is told to do so.
