Military commander affirms punishment of Army birther who balked at obeying Obama

FORT MEADE, Md. — The commander of the Military District of Washington is affirming the six-month prison sentence of an Army doctor who disobeyed deployment orders because he doubted President Barack Obama's eligibility to serve as commander-in-chief.

A spokeswoman said Friday that Army Maj. Gen. Karl Horst has approved the findings and sentence of Lt. Col. Terrence Lakin's court-martial in December.

I think you've missed the point. In military law, the convening authority must "affirm" the decision of the court-martial. It is then that the case is eligible for appeal.

The MSM is just reporting on this continuing legal saga. That's all.

Damn straight. It takes a helluva lot of guts to disobey an unlawful order, knowing the whole time you're going to be hung out to dry for doing so. Just ask Michael New.

And before the smart-ass chorus chimes in, yes, I know New was busted on drug charges after he was discharged. The operative word is after.

But hasn’t Lakin served 4 of the 6 month prison sentence? This story was all over the news yesterday as if it were new, as in he was found guilty/sentenced yesterday.

So it’s only an affirmation of the Dec decision? He can now appeal at least the other parts of the sentence if he wishes?

Perhaps he was up until the time he folded just before sentencing.

"...On Wednesday, however, Lakin reversed course, saying he would now deploy even with his question unanswered. Puckett asked him why.

"That's my duty. It's what I've trained for. I'm in the Army," he replied.

"Are we done disobeying orders, Lt. Col. Lakin?" his attorney asked him.
"Yes," Lakin replied."

This eleventh hour change of heart did not impress the court and they sentenced him to prison.

Oh, I probably should add that the charges to which he pleaded guilty, are a little more problematic to appeal - not necessarily impossible, but not automatic like the charges that there was a finding of guilt, FWIW.

Their oath is to defend and uphold the Constitution. It is not to uphold and defend likely corruption and fraud in the chain of command. When did turning one’s back to likely deceit, scamming, and lying become part of the military code of honor?

Given your reasoning, we should have robots defending us, not honorable men and women.

I am DISGUSTED with our highest military leadership! These highest military are either stupid or corrupt if they can ignore Obama’s eligibility. Where is the evidence that they peacefully and lawfully clarified the issue with Obama, congress, and the courts?

We know they are not stupid, so that leaves only one other option: corrupt!

Fundamentally, there are 4 balances of power in the United States of America. If the Constitution is under attack by a despicable congress, incompetent court toadies, beguiled voters, and a fraudulent presidency, then the last bulwark of defense for our Constitution is our highest military leadership. They are the last line before the Second Amendment becomes necessary.

There is absolutely no way we, as citizens, can depend on our highest military to defend the Constitution against domestic enemies. They may be willing to fall on a grenade for their troops in a battle against a foreign enemy, but it is evident, if confronted with a domestic enemy, they will put their careers and perks ahead of their troops, and the Constitution. They will be on their knees licking the jack boots crushing the necks of Americans.
