Detectives arrested Raul Barrera, 33, who lived with the her and charged him with second-degree murder. So, if he had chopped her head all the way off, they would have upped it to first-degree murder?

In NY 1st degree means murder with “special circumstances”. These can include the victim being a police officer, corrections officer or judge; the use of torture; multiple murders and terrorism.
