Woman sentenced to indefinite jury duty after making racist remarks on a questionnaire
Daily Mail UK ^ | April 6, 2011

A female juror in a high-profile American mafia murder trial was sentenced to indefinite jury duty after giving racist answers to a court questionnaire.

The Asian woman in her 20s was asked along with hundreds of others to provide answers to the survey prior to serving on the jury for the trial of crime boss Vincent Basciano.

But the woman enraged a Federal Court judge in New York by answering the question, 'Name three people you least admire', with the answer: 'African-Americans, Hispanics and Haitians.'

When asked by a judge at Brooklyn Federal Court to explain her answer, she replied: 'You always hear about them in the news doing something.'

The woman, known only as 'Juror No. 799', went on to claim all police officers are lazy, and only use their sirens to bypass traffic jams.

Lawyers in the case successfully requested she be removed from jury duty in Basciano's trial due to her 'inappropriate' comments.

A furious judge, Nicholas Garaufis, held up the woman's questionnaire in court and told her: 'This is an outrage, and so are you!' Referring to her racist answers, Judge Garaufis sarcastically asked the juror: 'Why didn't you put Asians down also?'

The woman replied: 'Maybe I should have.'

Jurors in America have been known to try to escape jury duty by providing outlandish answers to jury questionnaires.

But the Asian woman's views evidently backfired, as she has since been told she will serve on the jury until the judge deems her ready for release.

You know nothing about her and yet you feel able to reach judgment on her. You are assuming based on a short article.

Some people here think she is a racist and therefore would not make a good juror so she should be dismissed. Other, myself included, think she answered the question that way as an attempt to be dismissed from jury duty.

Either way, (blatant racist or civic slacker) she should not be 'rewarded' by getting off while others are serving and sacrificing to do their duty. She should sit there along with the others.

No, they are there for the term of the trial.

The length of trials are indefinite. Some trials scheduled to take a day, take a week. Others can go on for months. Those who serve on the trial of this mafia clown will be sequestered for several weeks and they and their families could possibly be in physical danger. Those people I respect.

Meanwhile, this bitch (be she a racist or a failed scammer) will just be sitting around the courthouse for some period of time bored stiff. Boo freakin who. Cry me a river.

She’s had puppies?

Either way, racist or slacker, she's a bitch. If it were a guy, I'd call him a bastard and I don't care if his parents were married or not.

I have zero respect for people who shirk their duty.

She’s entitled to her views. If she disapproves of or dislikes certain cultures, that’s her right under the First Amendment.

That judge should be impeached for punishing a juror for exercising her constitutionally protected speech.

Most people don’t belong on a jury.

Sorry; you're already committed to the position that she was honestly stating her opinion.

Hang it up dude. I was responding to the guy who said she was just telling the truth. If I had to bet, she's a not too bright person who believed the urban legend that you can get out of jury duty by saying you are a racist.

Either way, it does not matter. She does not get a pass for being racist or a slacker.

How can you possibly defend this woman? Do you believe in trial by jury? Do you think jury duty should be optional?

Your argument would make some sense if she’d said she doesn’t admire Italians or “dagos”. Your argument might even be believable if she’d said she doesn’t admire “n-g—rs, Haitians and wetb—ks”, but she didn’t.

If she doesn’t like specific cultures, why shouldn’t she say so? Should she lie and say everyone is wonderful and she admires every man, woman and child on earth? Is everyone wonderful? Is every culture wonderful?

I don’t think so.

And even if she was scamming to get off the jury, maybe she has a reason. Maybe she’s afraid to sit on a jury in a mafia trial because she’s afraid of mafia coercion/intimidation/violence/death. We all know how great law enforcement is at protecting people, right?

You’re not a mind reader and you have no idea what’s in somebody else’s heart.

LOL.

The SPLC (and the ACLU, ADL, etc.) don’t want that.

They’d go broke.

So now every Black, Hispanic or Haitian who gets convicted of a crime with this woman on the jury will be able to overturn the decision due to the jurist’s racism.

You show ‘em judge!

Most people don’t belong on a jury.

Probably true, and most people will never serve on a jury. But it is not a self disqualification process. The judge and lawyers decide who is and isn't qualified.

Was the woman a “peer” of the defendant, as specified in the Magna Carta?

If you read the article, they asked that in the questionnaire she filled out. They didn't indicate how she answered that.

That makes no sense. She didn’t list Italians and she didn’t list the judge himself, the defendant or the lawyers. She listed ethnicities irrelevant to the case. :)

How is it that she’s a racist? Maybe her breadth of experiences with those cultures have all or mostly all been negative. Maybe she thinks they commit too many crimes and suck up too much taxpayer money through their societal failures, begging, thieving and political whoring.

Just a thought.

Not exactly much of a punishment if she happens to work for a company like mine that still pays you your full salary if you are called to jury duty AND allows you to keep the daily stipend that the federal court pays you. She might end up making money off this process...

Maybe they don’t care how people answer that except for statistical purposes for manpower allocation, which translates to more public union jobs. Just because they ask the question doesn’t mean they’re offering protection.

Why the hell do you have even a shred of sympathy for this woman bitch?

Because she made a negative comment about three groups of people who are generally disdained and commonly bashed around here. If she had said "whites, Jews and Italians", she would be getting blasted and most would be agreeing with you.
