Going After Wal-Mart

Law: If there was ever such a thing as junk justice, the suit against Wal-Mart now in the Supreme Court is exhibit A. By claiming that evidence is no longer needed to prove discrimination, what's proven is the greed of lawyers.

Tuesday was a queasy day at the Supreme Court as lawyers in the largest class-action lawsuit in history made the claim that Wal-Mart discriminated against all 1.6 million of its female employees.

Nearly all the justices reportedly were unimpressed with the overreaching premise. It boils down to the idea that if six women could prove discrimination at one company — as happened in this case at 13 Wal-Mart stores — then, heck, 1.6 million other women who work for the same company should be included, too.

It's nothing but a bid to multiply a few instances of possible sex discrimination into a multibillion-dollar payout that will leave everyone else a loser.

Not since the Amazon Defense Front brought its spurious $100 billion lawsuit against Chevron in Ecuador has a flimsier case with higher stakes been brought before a high court. In Wal-Mart's case, as in Chevron's, it has been going on for at least a decade, as one judge after another bought into the absurd idea that discrimination can be proven just by statistics.

In Wal-Mart's case, 80% of its retail workforce is female, while only 33% of managers are. That said, it has had anti-discriminatory policies in place for decades.

According to the complaint: "Wal-Mart fosters or facilitates gender-stereotyping and discrimination ... and that this discrimination is common to all women who work or have worked in Wal-Mart stores."

The average wage for women is $13,000 and for men its $14,000.

All that proves is you can’t make much money working for Walmart.

Wal-Mart is hated by the liberals. They say that Wal-Mart imports inferior products from China, charges high prices, won’t cover employees under the corporate healthcare plan, drives small businesses out of business, have high employee turnover, have inferior product selection, and treat their employees badly. Also, apparently Wal-Mart does what they can legally to discourage unions in their stores.

So for these and other reasons, the liberals hate Wal-Mart. So it’s not surprising that Wal-Mart is a target of a major lawsuit.

Walmart is the target of a major lawsuit because it has deep pockets. Nothing more and nothing less.

Next will be a race discrimination suit against the U.s. olympic Team, because there aren't a sufficient representative swimmers who are black.....

America needs a "do-over".

This is the absurd basis of proof of discriminatory hiring practices.

If, for example, you give an employment test and X % of minorities fail, that is sufficient proof that the test discriminates against minorities.

Actually you can but most of the people who work there are like most people in retail. They are working part time.

Yes it means most positions there make between 13 and 14 k a year.

You’d think they would be asking the low muckety mucks if they WANT to be managers. It would be unsurprising if many more men were up to that aspiration than women, because it’s a demanding job, not just a clock in clock out task.
