There is a huge class action (women) discrimination lawsuit against Walmarts in front of the SCOTUS today. That libertarian judge on FNC was saying that all plaintiffs have to prove in discrimination cases is desperate impact(meaning a policy ended up with relatively negative results to a protected class), not intent of discrimation .
