Walmart Gets Punked by Frivolous Lawsuit

Walmart is getting sued by 6 women for sex discrimination; this despite the fact that most of the employees are women. The ambulance-chasing shysters fomenting this case succeeded in getting “class” status for their few plaintiffs from the notorious 9th Circuit Court of Appeals. One of the primary tests for certifying a lawsuit as a “class” is for the court to determine whether the named plaintiffs are sufficiently representative of the class. Additionally, the court must determine if actual discrimination occurred and that this discrimination was likely to be widespread and effect a large class; in this case, a half of million female employees.

I wonder if Walmart will simply fight this out like they do with most such lawsuits. If they do, instead of simply settling the case, they do stand a chance of losing less.

In a perfect world, they could go after all the plaintiffs for the costs of their legal defense.

My wife is a salaried employee of W-M and a very nice salary at that. She travels a lot on her job and tells me that she has not seen discrimination first hand and if it exists it is in individual stores, where managers have a certain amount of autonomy and it is certainly not a W-M policy. She was asked to join this class action suit and declined.

You are correct, W-M won't pay for any outrageous jury award, customers will.

I'm not surprised that this was given the green light by the 9th circuit. That court should be disbanded in the next republican administration, if at all possible and start all over with a new one.

well, I suppose if their promotion policies were covered in a collective bargaining agreement with some union they'd be exempt from these types of lawsuits, wouldn't they? Hmmmmm...........

But one of these women was actually told to make her appearance more attractive. Oh the horror. That alone should be worth billions. Meanwhile we have to listen to that &?$@, Palin. (fill in the four letter profanity of your choice, they are all PC and socially acceptable).

This case is going before the Supreme Court, where Justice Alito will mouth to the plaintiffs’ shyster attorney, “That’s not true.”

My guess is 5-4 Walmart.

My wife is also a salared employee of W-M. She believes that W-M is biased toward hiring and in promiting Black Women.

I suspect analysis would show that females made less effort to get promotions and raises, and that pretty well explains any disparities. Also that more men work full-time than women, which does put them at greater chance of promotion.
