Washington says phase in health-care reform, or else

WASHINGTON — If Florida leaders refuse to carry out the new national health-care law, Uncle Sam is prepared to take charge on behalf of the state’s consumers.

One year after President Barack Obama signed the health-care overhaul into law, federal officials are urging Florida and other reluctant states to shape it to meet their needs and to take advantage of millions of dollars of federal planning grants. Failure to participate, officials warned this week, means a loss of state control.

Florida and other states, for example, must show by 2013 they are set up to provide a health-insurance exchange, an online service for consumers to compare coverage plans and shop for affordable rates. If states are unwilling or unprepared, the law requires U.S. officials to step in and make a federal-run exchange available for residents at the start of 2014.

But Florida Gov. Rick Scott — backed by fellow Republicans in the Legislature who strongly oppose “ObamaCare” — has refused $2 million in federal planning money and ordered state agencies not to implement the law. In addition, Florida has challenged the law in federal court, in a lawsuit filed before Scott was elected in November.

This is a Constitutional Issue.

The states are trying to get the Federal Courts to resolve it.

The bastard is trying to block them.

This isn’t the kind of banana republic the bastard grew up in.

The states should hang tight and refuse to kunckle under until the Courts have their say and the GOP should find their testacles and introduce articles of impeachment against the bastard.

Sounds like we have a real potential for a Constitutional crisis, and that the electorate will soon become familiar with the 10th Amendment.

I certainly hope those articles would include not only the contempt of court charges from the gulf oil moratorium and the obamacare injunction but the 16 Social Security numbers he has used and the vote fraud during his time at ACORN.


I just hope that somewhere there is an FBI agent that has been off the books beavering away for years on this.

Btw, under what part of the Constitution does the federal Gov’t have the authority to make any state implement Obamacare? The Constitution is the supreme law of land.

Like I said, the district court ruling means nothing. There is no injunction, and Obama’s fedgov doesn't care.

It would help if the Federal judge who found Obamacare to be unconstitutional would issue an injunction on implementation pending a definitive ruling. Once the infrastructure starts going into place constitutionality will rapidly become a moot point. How come the states aren’t insisting an unequivocal stay on this?

The Constitution doesn’t grant the feds that authority, but technically, they aren’t exercising such authority under PPACA. They’re just saying to states “if you don’t set up exchanges by X date, we will.” So states are “voluntarily” complying by virtue of being put between a rock and a hard place. Ugly politics, but not unconstitutional (unfortunately).
