New Jersey court reverses Governor Christie’s budget cuts to public school aid

A New Jersey court, Tuesday, took a step further in effectively tying Republican Governor Chris Christie’s hands on budget and education reform. Superior Court Judge Peter Doyne ruled that Christie’s budget cuts to school aid left public schools unable to provide a “thorough and efficient” education to New Jersey children.

Now, the case goes to the state Supreme Court where those seven judges will decide whether to act on it or not.

Doyne’s decision is based on a decades-old ruling in the case Abbott vs. Burke that says the New Jersey state government has to equalize funding for all public schools. The intent was to make sure low-income or poorly performing schools weren’t left out during the appropriating process, but today, the ruling is considered to be one of the most progressive in the country.

...Abbott vs. Burke...ah yes, the famous Abbott Districts - certain "poor" school districts throughout the state which the court mandated had to receive state money to bring their funding up to - not just the state average in school spending - but up to the level of spending of the most affluent districts in the state - so we're putting $25000.00 per into students in Newark, for example, and they still fail the state competency test three times and get a runner-up high school diploma - psychosis reigns.....

Well, to enforce that, the judge needs to issue a ruling willing the money into existence. Otherwise, how can this ruling be enforced? You can’t rule money must be spent that does not exist.

A judiciary out of control - now judges ruling on how much a budget must be set at?

“I can’t say I’m familiar with the constitution of the state of New Jersey, but I’m pretty confident that constitution cedes ZERO power to the judiciary to tax and spend.”

According to liberals and many republicans the Courts have absolute and dictatorial power in their obviously arbitrary power to define what the Constitution says.

If that is true then we need only control the Federal courts, to render the actions of the other 2 branches meaningless.

Which is why I predict that ultimately as our effective “democracy” decays into a dictatorship the next target for assassination will not be the president or senators, but the judges.

Their assassinations can give your side which happens to control the legislator and executive lasting dictatorial power. At least under modern behavior of the Federal courts which have presumed themselves Not the States who so ratified the final word on the Constitution.

At the end of the day the Left has no desire to live in peace, they want Government slaves of us all. Likewise we who would be free men can’t live in slavery to the Government.

With the Constitution no longer our shield against limitless Government this is going to be a fight to the death.

Maybe they should bounce a few of “His Honor’s” monthly paychecks to show how broke the State is.
