I heard that she is up for election in April. This is just a cheap campaign stunt.

The judge, who ruled against the Madison school district that wanted an injunction to order absent teachers back to work, based her stay on a claim that the senators were required to notify absent senators of the upcoming session. But since they were in special session, those rules didn’t apply. And even though they weren’t required to notify anyone under the rules, they notified the absent senators via their Senate email accounts and also posted notification on the Senate online bulletin board. To sum up, they did what they weren’t required to do. She has no legal basis for her action. She’s a partisan hack.

Fact is, this upcoming Wis Supreme Court election (April 5th) will tell all politically. Good (Prosser) vs. Evil (Ol' what's her name?)and the libs are enraged...we'll see. Hopefully a photo ID will be required by then.

How is she vulnerable? She's a liberal judge from Dane County who is probably a hero to the majority of people in her liberal area of the state. I think she is running with no opposition, but I don't think there is any chance a conservative can win that race no matter who we put up.

Too many people seem to believe that the state is with Walker and against the Democrats. Unfortunately, this is just not the case. At best, it's a 50/50 split, more likely the Democrat/union position has more sympathy at the moment.

We need to do a much better job on the public relations front. Walker let this drag out too long and allowed the left to mobilize their forces, get their teachers out into the street to whine and cry (which almost always evokes sympathy), etc.

What really surprises me most is that so many conservatives actually thought this fight was over when Walker signed the bill. That is just the beginning. The leftists will use the courts to tie this thing up for as long as possible and hope their recall efforts change the balance of the legislature (state senate).

No, she based it on the expectation, on the part of the statute, that the public obtain notice of the meeting.

I agree with your overall conclusion about the judge, by the way. The decision is flawed, but for other reasons.

“Neither party has cited any rule that would have
overridden the clear provisions of the notice requirement in §19.84.
Likewise, the court has not been given any reason why there was not the full 24 hours notice, nor any other basis upon which the State could claim that there was good cause for failure to provide timely notice.”

I guess the fact that they were in Special Session didn’t matter to this judge despite there being a rule that notification isn’t required during Special Session.

I read her decision. Seems like a lot of wishes and fishes.

The point of the open meetings law is to prevent action from being taken in private. Enacting laws the public has no notice about nor ability to comment on.

Who in the State of Wisconsin didn’t know about this meeting or law? For crying out loud, all those hearings and votes were on statewide live tv. Days of testimony. Weeks of waiting for the dems to come back and vote on it.

What a ridiculous opinion.

She’s running unopposed, not a stunt, just a typical Madison liberal.

To a liberal the end always justifies the means. The black robe just tends to give her behavior validity to some for the moment.

Sumi also refused to issue an order for the Madison teachers to return from their illegal strike in the early days of the Madison riots.

And the senate makes it’s own rules, not the judiciary.

the judge is wrong. the law is on the side of the legislature.
