They must be thinking two things. One, is that the current court would rule against. Two, is that one of the conservatives will be leaving soon.

Why should the Supreme Court be outraged by this? The Obama administration is a party to a lawsuit, and responded to a request made by the opposing side. Nothing outrageous here.

Sorry - not an attorney. I just assumed this was something for the courts to settle, without input from the White House.

This is clearly a stalling tactic (0 knows that the Supreme Court, as currently constituted, would strike down the law), but it's not any sort of misuse of power.
